How do I know if my site discharges to a priority watershed?
Priority construction sites include any site that discharges to:
- A waterbody which is listed on the most recently EPA-approved 303(d) list of impaired waters for turbidity, siltation, or sedimentation,
- Any waterbody for which a TMDL has been finalized or approved by the EPA for turbidity, siltation, or sedimentation only for the purposes of the CGP
- Any waterbody assigned the Outstanding Alabama Water use classification in accordance with ADEM Admin. Code r. 335-6-10-.09, and
- Any waterbody assigned a special designation in accordance with ADEM Admin. Code r. 335-6-10-.10, the CBMPP must be submitted to ADEM for review along with the NOI.
The Construction Best Management Practice Plan (CBMPP) must be submitted along with the NOI if your site is located in a watershed that contains a waterbody assigned with one of the special designations mentioned above.
Please refer to the CSW Map to determine if the site discharges to a priority watershed. If your site falls within or discharges to a colored shapefile or segment, then your site is a priority site.
- Please Note: The impaired water Three Mile Branch in Montgomery County is a 303(d) impairment, not a TMDL. This issue will be resolved in 2026.
