The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

BALDWIN COUNTY

Aquila Seafood, Inc., PO Box 150, Bon Secour, AL 36511, NPDES Permit Number AL0002321, located at 17309 River Road, Bon Secour, AL 36511, for reissuance of a permit which authorizes discharges resulting from screened washdown water from seafood packing and freezing operations, cooler water, and screened water from loading/unloading of seafood, through DSN001 to Bon Secour River, classified as Swimming/Fish and Wildlife, in the Mobile River Basin.

Castle Rock Industries II, LLC, 101 Technacenter Drive, Montgomery, AL 36117, NPDES Permit Number AL0080446, located at 3791 Alabama Hwy 41, Selma, AL 36701, for reissuance of a permit which authorizes discharges resulting from clean-up wastewater and stormwater associated with the manufacture of refined oil and its by-products, through DSN001 and DSN002 to an unnamed tributary to Six Mile Creek, classified as Fish & Wildlife, in Alabama River Basin.

BFI Waste Systems of Alabama, LLC – Timberlands Landfill, 2910 North Palafox Street, Pensacola, FL 32501, NPDES Permit Number AL0079171, located at 22800 Highway 41, Brewton, AL 36426, for reissuance of a permit which authorizes discharges resulting from stormwater runoff from landfill operations, through DSN001, DSN002, DSN003, DSN004, DSN005, and DSN006 to an unnamed tributary to Burnt Corn Creek, classified as Fish and Wildlife, in the Perdido-Escambia River Basin; process wastewater from treated landfill leachate and stormwater runoff from landfill operations, through DSN007 to Burnt Corn Creek, classified as Swimming/Fish and Wildlife, in the Perdido-Escambia River Basin; and stormwater and groundwater from the sedimentation ponds serving the borrow pit areas, through DSN008 and DSN009 to an unnamed tributary to Burnt Corn Creek, classified as Fish & Wildlife, in the Perdido-Escambia River Basin.

Mobile County Commission – North Mobile County Industrial Park, 205 Government St, Mobile, AL 36602, NPDES Permit Number AL0076376, located at US Highway 43 North, Axis, AL 36505, for reissuance of a permit which authorizes discharges resulting from storm water runoff associated with a closed landfill operation, through DSN004 to an unnamed tributary to Cold Creek, classified as Fish & Wildlife, in Mobile River Basin.

Urban Oil and Gas, LLC – White Oak Creek CBM Project, 1000 East 14th Street, Suite 300, Plano, Texas 75074, NPDES Permit Number AL0068390, located at 58 Tiger Mine Road, Oakman, Tuscaloosa and Walker Counties, Alabama, for issuance of a permit that limits discharges of produced water from a coalbed methane operation and associated areas, discharging to the Black Warrior River, classified as Public Water Supply, Swimming and Other Whole Body Water-Contact Sports, and Fish and Wildlife, in the Black Warrior River Basin.

The subject permit regulates the discharge of treated wastewater to the Unnamed Tributary to Locust Fork, which is classified as Fish and Wildlife (F & W), in the Black Warrior River Basin.

Town of Cleveland, Post Office Box 186, Cleveland, AL 35049, NPDES Permit Number AL0073261, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Cleveland WWTP, Blount County Highway 1, Cleveland, AL 35049, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Unnamed Tributary to Dry Creek, which is classified as Fish and Wildlife (F & W), in the Black Warrior River Basin.

CALHOUN COUNTY

Township Services Corporation, 61 Lake Drive, Glencoe, AL 35905, NPDES Permit Number AL0066630, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Silver Lakes Wastewater Treatment Facility, Gilberts Ferry Road, Glencoe, AL 35905, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Ohatchee Creek, classified as Fish and Wildlife, in the Coosa River Basin.

DALLAS COUNTY

Jimmy Dwayne Duke, 148 Laurie Ln, Marion Jct, AL 36759-3472, NPDES Permit Number AL0045861, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Mary's Place, 12278 Alabama Hwy 14 West, Valley Grande, AL 36701, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Tate Branch, which is classified as Fish and Wildlife, in the Cahaba River Basin.

MARION COUNTY

Upper Bear Creek Water, Sewer & Fire Protection District, P.O. BOX 326, Haleyville, AL 35565, NPDES Permit Number AL0052311, for reissuance of a permit which limits the discharge of pollutants from filter backwash from Upper Bear Creek WTP, 339 County Road 62, Bear Creek, AL 35543, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of filter backwash to Bear Creek, which is classified as Swimming and Other Whole Body Water-Contact Sports, Fish and Wildlife, in the Tombigbee River Basin.

MARSHALL COUNTY

Cherokee Ridge Property Owners Association, 4000 Cherokee Ridge Drive, Union Grove, AL 35175, NPDES Permit Number AL0064181, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Cherokee Ridge Property Owners Association WWTP, 4000 Cherokee Ridge Drive, Union Grove, AL 35175, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to a Sprayfield in the Tennessee River Basin. The facility is located in the drainage basin of UT to Hughes Creek, a waterway classified as Fish and Wildlife, in the Tennessee River Basin.

MONTGOMERY COUNTY

Montgomery Water Works and Sanitary Sewer Board, Post Office Box 1631, Montgomery, AL 36102, NPDES Permit Number AL0022241, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater and stormwater runoff from Towassa WWTP, 3000 Washington Ferry Road, Montgomery, Alabama 36108, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to the Alabama River (Woodruff Lake), which is classified as Fish and Wildlife, in the Alabama River Basin.

WILCOX COUNTY

Wilcox County Water & Sewer District, Post Office Box 190, Camden, AL 36726, NPDES Permit Number AL0079081, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Meadowbrook HCR Lagoon, End of County Road 65, Camden, AL 36726, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Pursley Creek, which is classified as Fish and Wildlife (F&W), in the Alabama River Basin.


The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations; and for those in the coastal area, are consistent with the Alabama Coastal Management Program.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/public-notices, and at the following location, by appointment, Monday – Friday (except legal holidays), 8:00 am to 5:00 pm. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice. COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS. In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit. The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record. The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.
