NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE
INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS
The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:
Industrial Facilities
COLBERT COUNTY
Essity Professional Hygiene North America, LLC, 1834 Haley Dr, Cherokee, AL 35616, NPDES Permit Number AL0074667, located at the same address, for reissuance of a permit which authorizes discharges resulting from treated process wastewaters including boiler area wastewaters, cooling tower blowdown, converting printing wastewaters, maintenance waters and stormwater runoff from process areas, through DSN001 to the Tennessee River (Pickwick Lake), classified as Fish & Wildlife, Swimming, and Public Water Supply, in the Tennessee River Basin; stormwater from process areas and DSN02A1 (wastewater resulting from paper machine basement overflow, GeoTube ® Filrate, overflow of treated river water, commissioning water, water treatment tank draining, fire suppression system test water, steam condensate, and boiler area waters including boiler blowdown, pump seal water and sand filter back-flush water), through DSN002 into Mulberry Creek, classified as Fish & Wildlife, in the Tennessee River Basin; and stormwater runoff from mill access road, through DSN003 into an unnamed tributary to Mulberry Creek, classified as Fish & Wildlife, in the Tennessee River Basin. The Department has determined that the facility is not subject to Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326) since the entity providing water is a public water system in accordance with Section 1401 of the Safe Drinking Water Act, and water withdrawn from the intake is not withdrawn exclusively for cooling purposes.

Littrell Brothers Lumber Company, PO Box 40, Vinemont, AL 35179, NPDES Permit Number AL0066460, located at 20345 US Hwy 31, Vinemont, AL 35179, for reissuance of a permit which authorizes discharges resulting from stormwater associated with lumber and wood products industry including wood treating operations, through DSN001 to an unnamed tributary to East Fork Flint Creek, classified as Fish & Wildlife, in the Tennessee River Basin.
JACKSON COUNTY
WestRock CP, LLC – Stevenson Mill, 1611 County Road 85, Stevenson, AL 35772, NPDES Permit Number AL0022314, located at the same address, for reissuance of a permit which authorizes discharges resulting from process wastewater from paperboard manufacturing, landfill leachate, and stormwater associated with industrial activity, through DSN001 to the Tennessee River, classified as Public Water Supply, Swimming, and Fish & Wildlife, in the Tennessee River Basin; treated sanitary wastewater, through DSN002 to the Tennessee River, classified as Public Water Supply, Swimming, Fish & Wildlife, in the Tennessee River Basin; landfill leachate and stormwater associated with industrial activity, through DSN005 to an unnamed tributary to Tennessee River, classified as Fish and Wildlife, in the Tennessee River Basin; stormwater associated with industrial activity, through DSN006 and DSN022 to an unnamed tributary to Tennessee River, classified as Fish & Wildlife, in the Tennessee River Basin; process discharges associated with exterior rail car washing operations and stormwater runoff from industrial activity, through DSN023 to an unnamed tributary to Tennessee River, classified as Fish & Wildlife, in the Tennessee River Basin; stormwater and contact water from wet decking operations, through DSN024 to an unnamed tributary to Bengis Creek, classified as Fish & Wildlife, in the Tennessee River Basin; and stormwater associated with areas around wet decking operations, through DSN025 to an unnamed tributary to Bengis Creek, classified as Fish & Wildlife, in the Tennessee River Basin. At this time, the Department has made a best professional judgement (BPJ) determination that the cooling water intake structure represents the best technology available (BTA) to minimize adverse environmental impact in accordance with Section 316(b) of the Federal Clean Water Act (33 U.S.C. sSection 1326)

Town of Gurley, Post Office Box 128, Gurley, AL 35748, NPDES Permit Number AL0070661, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater from Gurley WWTP, 204 Childress Street, Gurley, AL 35748, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Hurricane Creek, which is classified as Fish and Wildlife (F&W), and to the Flint River, which is classified as F&W, both in the Tennessee River Basin.
MARSHALL COUNTY
LG Utilities LLC, PO Box 805, Guntersville, AL 35976, NPDES Permit Number AL0042366, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from LG Utilities LLC WWTP, 133 Riverbend Circle, Guntersville, AL 35976, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Tennessee River (Guntersville Lake), classified as Swimming and Fish and Wildlife, in the Tennessee River Basin.
SUMTER COUNTY
Sumter County Sewer Authority, Post Office Box 115, Emelle, AL 35459, NPDES Permit Number AL0080306, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Wendy Hills Lagoon, Wendy Hills Road, Gainesville, AL 35464, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Toms Creek, which is classified as Fish and Wildlife, in the Tombigbee River.
TUSCALOOSA COUNTY
ST Exit 62, LLC, 1301 Industrial Park Drive, Tuscaloosa, AL 35401, NPDES Permit Number AL0079774, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Fosters Water Treatment Facility, Off I20 / I59 SW 1/4 S4 & NW 1/4 S9, T24N, R4E, Fosters, AL 35463, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Grant Creek, which is classified as Fish and Wildlife, in the Black Warrior River Basin.
The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations.
Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/public-notices, and at the following location, by appointment, Monday – Friday (except legal holidays), 8:00 am to 5:00 pm. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice. COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS. In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.
A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit. The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.
After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record. The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.
