NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

JACKSON COUNTY

Amrize Cement Inc. - Theodore Plant, PO BOX 649, Theodore, AL 36590, NPDES Permit Number AL0028801, located at 3051 Hamilton Boulevard, Theodore, AL 36582, for reissuance of a permit which authorizes discharges resulting from material storage pile runoff, cooling tower blowdown, once through cooling water, vehicle and equipment wash water, dike drainage from storage areas, fire test water, plant site wash water, and plant site storm water runoff, through DSN001 to Middle Fork Deer River (Theodore Barge Canal), classified as Fish and Wildlife, in the Mobile River Basin.

Southern Ionics Inc. - Chickasaw Facility, PO Box 1217 / 579 Commerce Street, West Point, MS 39773, NPDES Permit Number AL0068977, located at 1100 Viaduct Road North, Chickasaw, AL 36671, for reissuance of a permit which authorizes discharges resulting from storm water associated with the manufacturing of inorganic chemicals collected from secondary containment areas and truck and railcar loading and unloading areas, through DSN001 to Chickasaw Creek, classified as Limited Warmwater Fishery, in the Mobile River Basin.

JEFFERSON COUNTY

Drummond Company, Inc. - Mine #89, PO Box 1549, Jasper, Alabama 35502, NPDES Permit Number AL0060402, located on Bluff Creek Road, Jasper, Jefferson County, Alabama, for issuance of a permit that limits discharges from a dry preparation coal fines/refuse recovery operation and associated areas, discharging to Coal Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.

PB Services, LLC - Bessie Mine and Locust Fork Red Rock, 3700 14th Avenue North, Birmingham, Alabama 35234, NPDES Permit Number AL0003263, located at 5260 Bessie Flat Top Cutoff Road, Adamsville, Jefferson County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry preparation red rock mine, iron ore waste recovery from foundry waste, and associated areas, discharging to Locust Fork, classified as Swimming and Other Whole Body Water-Contact Sports and Fish and Wildlife, and to an unnamed tributary to Locust Fork, classified as Fish and Wildlife, in the Black Warrior River Basin.

Wiregrass Construction Company - Hickory Bend Mine, 1342 Carmichael Way, Montgomery, Alabama 36117, NPDES Permit Number AL0077631, located at 2291 Tysonville Loop, Shorter, Macon County, Alabama, for reissuance and modification of a permit that limits discharges of treated drainage from a wet and dry preparation construction sand and gravel mine and associated areas, discharging to Tallapoosa River, classified as Public Water Supply and Fish and Wildlife, Cubahatchee Creek, classified as Swimming and Other Whole Body Water-Contact Sports and Fish and Wildlife, and to an unnamed tributary to Tallapoosa River, unnamed tributaries to Cubahatchee Creek, unnamed tributaries to Line Creek, and Line Creek, classified as Fish and Wildlife, in the Tallapoosa River Basin.

General Shale Brick, Inc. dba Columbus Brick - Pittsview Mine, 5100 Brickyard Road, Columbia, South Carolina 29203, NPDES Permit Number AL0084534, located at 431 Highway West, Pittsview, Russell County, Alabama, for issuance of a permit that limits discharges of treated drainage from a shale and/or common clay mining operation and associated areas, discharging to an unnamed tributary to Watermelon Creek and an unnamed tributary to Weolustee Creek, classified as Fish and Wildlife, in the Chattahoochee River Basin.

The subject permit regulates the discharge of treated wastewater to the Locust Fork, which is classified as Fish and Wildlife, in the Black Warrior River Basin.

DALE COUNTY

Utilities Board of the City of Ozark, PO BOX 1125, Ozark, AL 36361-1125, NPDES Permit Number AL0056324, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and stormwater runoff from Ozark Southside WWTF, Alabama Highway 123, Ozark, AL 36361, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to the Klondike Creek, which is classified as Fish and Wildlife, in the Choctawhatchee River Basin.

DALLAS COUNTY

Dallas County Water And Sewer Authority, 2504 Old Montgomery Rd., Selma, AL 36703, NPDES Permit Number AL0043176, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and stormwater runoff from Dallas County WWTP, Craig Airport Authority Bldg 278, Selma, AL 36701, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to an unnamed tributary to Sixmile Creek, which is classified as Fish and Wildlife, in the Alabama River Basin.

ETOWAH COUNTY

Altoona Water and Sewer Board, Post Office Box 723, Altoona, AL 35952, NPDES Permit Number AL0021237, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Altoona Lagoon, 6350 Snead Cross Road, Altoona, AL 35952, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Locust Fork, classified as Swimming and Fish and Wildlife, in the Coosa River Basin.

The Water Works Board of the City of Attalla, 509 4th St NW, Attalla, AL 35954, NPDES Permit Number AL0067571, for reissuance of a permit which limits the discharge of pollutants from filter backwash from Attalla WTP, 1780 Highway 77, Attalla, AL 35954, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of filter backwash to a Big Wills Creek, classified as Swimming and Fish and Wildlife, in the Coosa River Basin.

GREENE COUNTY

Greene County Water and Sewer Authority, Post Office Box 656, Eutaw, AL 35462, NPDES Permit Number AL0074993, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Greenetrack WWT Lagoon, Behind Greenetrack Off County Road 208, Eutaw, AL 35462, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the UT to Minter Creek, which is classified as Fish and Wildlife, in the Black Warrior River Basin.

HOUSTON COUNTY

City of Taylor, 1469 South State Highway 605, Taylor, AL 36301, NPDES Permit Number AL0084000, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Taylor WWTP, 361 Friendship Lane, Taylor, AL 36301, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the unnamed tributary to Chipola Creek, which is classified as Fish and Wildlife, in the Chipola Basin.

JEFFERSON COUNTY

Asset Management Professionals, LLC, 3871 Pine Lane, Suite 141, Bessemer, AL 35022, NPDES Permit Number AL0045560, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Donaldson Correctional Facility WWTP, 100 Warrior Lane, Bessemer, AL 35023, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Big Branch, which is classified as Fish and Wildlife, in the Black Warrior River Basin.

LAUDERDALE COUNTY

Lauderdale County Board of Education, Post Office Box 278, Florence, AL 35631, NPDES Permit Number AL0057126, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Brooks High School WWTP, 4300 Highway 72, Killen, AL 35645, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Fourmile Creek, which is classified as Fish and Wildlife, in the Tennessee River Basin.

LIMESTONE COUNTY

Limestone County Water and Sewer Authority, 17218 Hwy 72 W, Athens, AL 35611, NPDES Permit Number AL0080217, for reissuance of a permit which limits the discharge of pollutants from filter backwash from Binford Turner WTP, 10992 US Hwy. 31, Tanner, AL 35671, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of filter backwash to an unnamed tributary to Swan Creek, which is classified as Fish and Wildlife, in the Tennessee River Basin.

The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations; and for those in the coastal area, are consistent with the Alabama Coastal Management Program.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/public-notices, and at the following location, by appointment, Monday – Friday (except legal holidays), 8:00 am to 5:00 pm. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice. COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS. In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit. The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record. The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.
