NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE
INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

COLBERT COUNTY

Robbins Holdings, Inc – Robbins, LLC, 3415 Thompson Street, Muscle Shoals, AL 35661, NPDES Permit Number AL0069931, located at the same address, for reissuance of a permit which authorizes discharges resulting from stormwater runoff, boiler blowdown, contact cooling water, and non-contact cooling water associated with the manufacture of rubber products, through Outfall DSN001 to an unnamed tributary to Spring Creek, classified as Fish and Wildlife, in the Tennessee River Basin.

Tennessee Valley Authority - TVA Colbert Combustion Turbines Facility, 307 Gas Turbine Road, Tuscumbia, AL 35674, NPDES Permit Number AL0003867, located at the same address, for reissuance of a permit which authorizes discharges resulting from process wastewaters including simple cycle power block - EVAP Blowdown, CT fuel secondary containment, and stormwater runoff associated with electric power generation, through Outfall DSN001 to Cane Creek, classified as Swimming, Fish and Wildlife, in the Tennessee River basin; stormwater runoff from the switchyard and south yard area including groundwater, through Outfall DSN004 to Cane Creek, classified as Swimming, Fish and Wildlife, in the Tennessee River basin; stormwater runoff from the closed Ash Stack 5 Area, through Outfall DSN010 to the Tennessee River (Pickwick Lake), classified as Public Water Supply and Swimming, Fish and Wildlife, in the Tennessee River basin; and stormwater runoff from the closed Ash Pond 4 Area, through Outfall DSN013, Outfall DSN016, and Outfall DSN017 to Cane Creek, classified as Swimming, Fish and Wildlife, in the Tennessee River basin. The Department has determined that the entity providing cooling water to the Permittee is a public water system in accordance with Section 1401 of the Safe Drinking Water Act; therefore, the Permittee is exempt from the requirements of Section 316(b) of the federal Clean Water Act (33 U.S.C. section 1326) and rules adopted under this section.

Tennessee Valley Authority - TVA Environmental Research Center, 1101 Market Street LP 5C-C, Chattanooga, Tennessee 37402, NPDES Permit Number AL0003891, located at Reservation Road, Muscle Shoals, AL 35662, for reissuance of a permit which authorizes discharges resulting from stormwater runoff associated with operation of a service shop, stormwater discharges from elemental phosphorus and ash settling pond SWMU104, and stormwater runoff associated with a site used for environmental and energy research and development, through Outfall DSN001 to Pond Creek, classified as Agricultural and Industrial Water Supply, in the Tennessee River Basin; and stormwater runoff associated with operation of a service shop and stormwater runoff associated with a site used for environmental and energy research and development, through Outfall DSN002 to Pond Creek, classified as Agricultural and Industrial Water Supply in the Tennessee River Basin.

COVINGTON COUNTY

Arclin USA LLC, 14139 US Highway 84, Andalusia, AL 36421, NPDES Permit Number AL0000868, located at the same address, for reissuance of a permit, which authorizes discharges resulting from treated process water, boiler blowdown, steam condensate, demineralizer rinse, non-contact cooling water, cooling tower blowdown, and stormwater discharging to an U.T. to Prestwood Creek, through DSN001 to an unnamed tributary to Prestwood Creek, classified as Fish & Wildlife, in the Perdido/Escambia River Basin; once-through non-contact cooling water, through DSN002 to an unnamed tributary to Prestwood Creek, classified as Fish & Wildlife, in the Perdido/Escambia River Basin; stormwater runoff commingled with air conditioner condensate and fire testing water, through DSN003 to an unnamed tributary to Prestwood Creek, classified as Fish & Wildlife, in the Perdido/Escambia River Basin; and treated process water, boiler blowdown, steam condensate, demineralizer rinse, non-contact cooling water, cooling tower blowdown, and stormwater discharging to the Conecuh River, through DSN004 to the Conecuh River, classified as Fish & Wildlife, in the Perdido/Escambia River Basin. The Department has determined that the entity providing cooling water to the Permittee is a public water system in accordance with Section 1401 of the Safe Drinking Water Act; therefore, the Permittee is exempt from the requirements of Section 316(b) of the federal Clean Water Act (33 U.S.C. section 1326) and rules adopted under this section.

JEFFERSON COUNTY

Nucor Steel Birmingham, Inc., PO Box 2764, Birmingham, AL 35234, NPDES Permit Number AL0003735, located at 2301 FL Shuttlesworth Drive, Birmingham, AL 35234, for reissuance of a permit, which authorizes discharges resulting from groundwater and storm water associated with steel mill operations, through DSN001 to Village Creek, classified as Limited Warmwater Fishery, in the Black Warrior River Basin; and groundwater, storm water, and process waters associated with steel mill operations, through DSN002 to Village Creek, classified as Limited Warmwater Fishery, in the Black Warrior River Basin. The Department has determined that the entity providing cooling water to the Permittee is a public water system in accordance with Section 1401 of the Safe Drinking Water Act; therefore, the Permittee is exempt from the requirements of Section 316(b) of the federal Clean Water Act (33 U.S.C. section 1326) and rules adopted under this section.

MOBILE COUNTY

Kimberly-Clark Corp, 200 Bay Bridge Rd, Mobile, AL 36610, NPDES Permit Number AL0002801, located at the same address, for reissuance of a permit, which authorizes discharges resulting from process wastewaters associated with tissue and towel manufacturing operations, steam and power generation, virgin fiber, waste cardboard and office paper processing, and stormwater runoff, through DSN001 to the Mobile River, classified as Limited Warmwater Fishery, in the Mobile River Basin; stormwater runoff from non-process areas associated with paper mill operations, through DSN002, DSN003, DSN004, DSN005, DSN008, and DSN013 to Chickasaw Creek, classified as Limited Warmwater Fishery, in the Mobile River Basin; stormwater runoff from warehouse roof drains, through DSN006 to Chickasaw Creek, classified as Limited Warmwater Fishery, in the Mobile River Basin; non-contact cooling water and stormwater runoff from non-process areas associated with paper mill operations, through DSN007 and DSN012 to Chickasaw Creek, classified as Limited Warmwater Fishery, in the Mobile River Basin; stormwater runoff from non-process areas associated with inert material storage, trailer parking, and contractor activities, through DSN009 and DSN010 to Chickasaw Creek, classified as Limited Warmwater Fishery, in the Mobile River Basin; stormwater runoff from distribution/shipping warehouse roof drains and adjacent areas surrounding the buildings, through DSN014, DSN015, DSN016, DSN017, DSN018, DSN019, and DSN020 to Threemile Creek, classified as Agricultural and Industrial Water Supply, in the Mobile River Basin; and stormwater runoff from non-process areas associated with temporary inert material storage and additional trailer parking, through DSN021 to Chickasaw Creek, classified as Limited Warmwater Fishery, in the Mobile River Basin.

Univar Solutions USA LLC, 701 Western Drive, Mobile, AL 36607 200, NPDES Permit Number AL0056316, located at the same address, for reissuance of a permit, which authorizes discharges resulting from stormwater runoff associated with repackaging and distribution of bulk industrial chemical products, through DSN001 to Threemile Creek, classified as Agricultural and Industrial Water Supply, in the Mobile River Basin.

St. Clair County Commission – Odenville Chert Pit, 165 5th Avenue, Suite 100, Ashville, Alabama 35953, NPDES Permit Number AL0081353, located at 226 Chert Pit Road, Odenville, St. Clair County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dirt and/or chert mine and associated areas, discharging to Groundwater and an unnamed tributary to Beaver Creek, classified as Fish and Wildlife, in the Coosa River Basin.

CALHOUN COUNTY

The Water Works & Sewer Board of the City of Anniston, PO Box 2268, Anniston, AL 36202, NPDES Permit Number AL0022195, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater from Choccolocco Creek WWTP, 35 Friendship Road, Oxford, AL 36203, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Choccolocco Creek, classified as Fish and Wildlife, in the Coosa River Basin. The subject permit also regulates the discharge of storm water runoff to UT to Choccolocco Creek, classified as Fish and Wildlife, in the Coosa River Basin.

JEFFERSON COUNTY

Enviro Services, LLC, 1000 Urban Center Dr, Suite 235, Vestavia Hills, AL 35242, NPDES Permit Number AL0067814, for revocation and reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and stormwater runoff from Liberty Park WRRF, 13059 Liberty Parkway, Vestavia Hills, AL 35242, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to a UT to Gumsuck Branch and treated wastewater to Gumsuck Branch, both of which are classified as Fish & Wildlife, in the Cahaba River Basin.

SWWC Services, Inc., 728 Volare Drive, Birmingham, AL 35244, NPDES Permit Number AL0051161, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Minor Middle School Lagoon, 400 Hillcrest Road, Adamsville, AL 35005, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to a UT to Prudes Creek, which is classified as Fish & Wildlife, in the Black Warrior River Basin.

LAWRENCE COUNTY

Lawerence County Board of Education, 14131 Market Street, Moulton, AL 35650, NPDES Permit Number AL0043044, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Mount Hope School Lagoon, 8455 County Road 23, Mount Hope, AL 35651, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Rock Springs Branch, classified as Fish and Wildlife, in the Tennessee River Basin.

WALKER COUNTY

Jasper Waterworks & Sewer Board, Inc., PO Box 1348, Jasper, AL 35502, NPDES Permit Number AL0023418, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater from Town Creek WWTP, 4000 Plant Road, Jasper, AL 35501, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Town Creek, classified as Limited Warmwater Fishery, in the Black Warrior River Basin. The subject permit also regulates the discharge of storm water runoff to Town Creek, classified as Limited Warmwater Fishery, in the Black Warrior River Basin.

WINSTON COUNTY

Town of Arley, PO Box 146, Arley, AL 35541, NPDES Permit Number AL0071188, for reissuance of a permit which limits the discharge of pollutants from filter backwash from Arley WTP, 1245 Winston County Road 63, Arley, AL 35541, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of filter backwash to Brushy Creek (Smith Lake), which is classified as Swimming, Fish and Wildlife, in the Black Warrior River Basin.


The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice. COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS. In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit. The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record. The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.
