Billys Seafood Inc., 16780 River Rd, Bon Secour, AL 36511, NPDES Permit Number AL0068497, located at the same address, for reissuance of a permit which authorizes discharges resulting from screened washdown water from seafood packing and freezing operations, through DSN001 to the Bon Secour River, classified as Swimming / Fish & Wildlife, in the Mobile River Basin; and discharge of water from loading and unloading of seafood, through DNS002 to the Bon Secour River, classified as Swimming / Fish & Wildlife, in the Mobile River Basin.

Tennessee Valley Authority - TVA Browns Ferry Nuclear Plant, Post Office Box 2000, NAB 2A, Decatur, Alabama 35609, NPDES Permit Number AL0022080, located at 10835 Shaw Road, Athens, Alabama 35611, for reissuance of a permit which authorizes discharges resulting from the diffuser discharge including discharges from the condenser cooling water system, raw water cooling system, fire protection system, turbine building sumps, reactor building cooling water, and Internal Outfall DSN01B which includes discharges associated with the liquid radwaste system including low volume wastes, through DSN001 to the Tennessee River (Wheeler Lake), classified as Swimming / Fish and Wildlife, in the Tennessee River Basin; discharges associated with the residual heat removal service water system, through DSN005 to the Tennessee River (Wheeler Lake), classified as Swimming / Fish and Wildlife, in the Tennessee River Basin; discharges associated with the intake screen backwash system and emergency equipment cooling waters, through DSN012 to the Tennessee River (Wheeler Lake), classified as Swimming / Fish and Wildlife, in the Tennessee River Basin; stormwater runoff associated with electric power generation including runoff from administrative buildings, parking lots, drainage areas around the sedimentation ponds, grassy areas of the plant yard, and Internal Outfall DSN13A which includes stormwater discharges associated with electric power generation including runoff from the 4 kV operator yard, the main plant transformer yard, the switchyard, parking lots, grassy areas of the plant yard and also including discharges from the wastewater lagoon system which includes treated sanitary wastewaters, photo development wastewaters, metal processing lab wastewaters, medical lab wastewaters, chiller blowdown, stand-by liquid control system waters, cooler/air compressor cleaning waters, filtered asbestos abatement wastewaters, and stormwater runoff, Internal Outfall DSN13B which includes low volume wastewater discharges from the sedimentation pond including the intake building sumps, diesel generator sumps, DI water filter backwash, DI water filtration system wastewaters, miscellaneous low volume wastes, and stormwater runoff associated with electric power generation, and Internal Outfall DSN13C which includes discharges from the wastewater lagoon system which includes treated sanitary wastewaters, photo development wastewaters, metal processing lab wastewaters, medical lab wastewaters, chiller blowdown, stand-by liquid control system waters, cooler/air compressor cleaning waters, filtered asbestos abatement wastewaters, and stormwater runoff associated with electric power generation including runoff from the 4 kV operator yard, the main plant transformer yard, the switchyard, parking lots, grassy areas of the plant yard, through DSN013 to the Tennessee River (Wheeler Lake), classified as Swimming / Fish and Wildlife, in the Tennessee River Basin; stormwater runoff from the north perimeter of the site generally not associated with industrial activity including run on from surrounding agricultural areas, through DSN014 to the Tennessee River (Wheeler Lake), classified as Swimming / Fish and Wildlife, in the Tennessee River Basin; fire system test/flush waters and stormwater runoff from administrative building, parking lots, non-industrial areas of the plant property, through DSN017 to the Tennessee River (Wheeler Lake), classified as Swimming / Fish and Wildlife, in the Tennessee River Basin; stormwater runoff associated with electric power generation including runoff from the Materials and Procurement Complex parking lot, the firing range parking lot, the facilities maintenance area, the vehicle fuel dispensing area, and grassy areas of the plant yard, through DSN018 to the Tennessee River (Wheeler Lake), classified as Swimming / Fish and Wildlife, in the Tennessee River Basin; stormwater runoff associated with electric power generation including runoff from the borrow pit, the fire training area, the low level radwaste storage facility, the inert landfill, and the 180 day hazardous waste storage area, through DSN019 to the Tennessee River (Wheeler Lake), classified as Swimming / Fish and Wildlife, in the Tennessee River Basin; and stormwater runoff associated with electric power generation including runoff from the northeast and east property perimeter, the vehicle service and mechanic shop, and stormwater run on from adjacent grassland and farmland, through DSN024 to an unnamed tributary to the Tennessee River (Wheeler Lake), classified as Fish and Wildlife, in the Tennessee River Basin. The thermal component of the discharge is subject to effluent limitations under CWA section 301 or 306. The Permittee has filed a request for the continuation of a variance established under Section 316(a) of the Federal Clean Water Act (33 U.S.C. section 1326) which provides for alternative limitations for the thermal discharges associated with cooling water discharges. The Department has proposed alternate thermal limitations which include a 90 °F rolling 7 - day average, a 93 °F maximum 1-hour average, and a maximum delta temperature rise of 10 °F over upstream ambient temperature based on the daily 24-hour calendar day average with a permit tier to account for natural cooling anomaly conditions. At this time, the Department has made a determination that the cooling water intake structure represents the best technology available (BTA) for entrainment to minimize adverse environmental impact in accordance with Section 316(b) of the Federal Clean Water Act (33 U.S.C. section 1326).

MOBILE COUNTY

Hawkins, Inc., 5275 I-10 Industrial Parkway S, Theodore, AL 36590, NPDES Permit Number AL0084077, located at the same address, for reissuance of a permit which authorizes discharges resulting from stormwater resulting from the sale and distribution of wastewater treatment chemicals, through DSN001 to Rabbit Creek, classified as Fish and Wildlife, in the Mobile River Basin.

TUSCALOOSA COUNTY

HENRY COUNTY

Imerys Refractory Minerals USA, Inc. – JL Corbitt Pit 1, 377 Highway 131, Eufaula, Alabama 36072, NPDES Permit No. AL0082163, located on County Road 207, Henry County, Alabama, for reissuance of a permit that limits discharges of treated drainage from a Bauxitic and Kaolin Clay mine and associated areas, discharging to Groundwater and an unnamed tributary to Little Piney Woods Creek, classified as Fish and Wildlife, in the Choctawhatchee River Basin.

MACON COUNTY

U.S. Silica Company, LLC - Hurtsboro Plant, 24275 Katy Freeway, Suite 600, Katy, Texas 77494-7271, NPDES Permit No. AL0064262, located at 12701 Highway 51 South Hurtsboro, Macon County, Alabama 36860, for reissuance of a permit that limits discharges of treated drainage from a wet and dry preparation Industrial Sand Plant and associated areas, discharging to an unnamed tributary to Middle Fork Cowikee Creek, classified and Fish and Wildlife, in the Chattahoochee River Basin.

The Water Works and Sewer Board of the City of Luverne, Post Office Box 249, Luverne, AL 36049, NPDES Permit Number AL0060534, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Luverne WWTP, West End of West 9th Street, Luverne, AL 36049, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Patsaliga Creek, which is classified as Fish and Wildlife, in the Escambia River Basin.

HOUSTON COUNTY

Houston County Commission, Post Office Box 6406, Dothan, AL 36302, NPDES Permit Number AL0072669, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Houston County Distribution Center WWTP, South County Road 55, Cottonwood, AL 36320, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Spring Creek, which is classified as Fish and Wildlife, in the Chipola River Basin.

LIMESTONE COUNTY

Water Works and Sewer Board of the Town of Ardmore, Post Office Box 26, Ardmore, TN 38449, NPDES Permit Number AL0023329, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Ardmore WWTP, 29529 Jones Avenue, Ardmore, AL 35739, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Piney Creek, which is classified as Fish and Wildlife in the Tennessee River Basin.

MADISON COUNTY

Harvest-Monrovia Water, Sewer, and Fire Protection Authority, PO Box 329, Harvest, AL 35749, NPDES Permit Number AL0070947, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Burwell Road WWTP, 5487 Highway 53, Harvest, AL 35749, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Dry Creek, which is classified as Fish and Wildlife, in the Tennessee River Basin.

Land Venues, Inc., 201 W. 2nd Avenue, Suite 201, Coal Valley, IL 61240, NPDES Permit Number AL0084510, for initial issuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Mia Rayne Subdivision WWTP, 10017 Wall Trianna Hwy, Harvest, AL 35773, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to an unnamed tributary to Limestone Creek, which is classified as Fish and Wildlife, in the Tennessee River Basin.

SHELBY COUNTY

Alabama Department of Conservation and Natural Resources, 64 North Union Street, Room 483, Montgomery, AL 36130, NPDES Permit Number AL0050831, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Oak Mountain State Park WWTP, 200 Terrace Drive, Pelham, AL 35124, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the UT to UT to Dry Brook, which is classified as Fish and Wildlife, in the Cahaba River Basin.

WALKER COUNTY

City of Cordova, 3885 N Massachusetts Ave Ste 103, Cordova, AL 35550, NPDES Permit Number AL0020427, for re-issuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Cordova WWTP, Walker County Road 30 SE 1/4 of NE 1/4 of Section 9, Township 15S, Range 6W, Cordova, AL 35550, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Mulberry Fork, classified as Public Water Supply and Fish and Wildlife, in the Black Warrior River Basin.

The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations; and for those in the coastal area, are consistent with the Alabama Coastal Management Program.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/public-notices, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm. Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice. COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS. In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit. The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record. The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.
