NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE
INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS
The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:
Industrial Facilities
BLOUNT COUNTY
*Tyson Farms Inc – Blountsville Processing, P.O. Box 547, Snead, AL 35952, NPDES Permit Number AL0001449, located at 67240 Main St, Blountsville, AL 35031, for reissuance of a permit which authorizes discharges resulting from treated process wastewater and clean-up water, sanitary wastewater, storm water, and treated poultry process wastewater, through DSN001 to Graves Creek, classified as Fish and Wildlife, in the Black Warrior River Basin; and storm water run-off associated with poultry processing operations, through DSN002 and DSN003 to Graves Creek, and DSN004 to an unnamed tributary to Graves Creek; both streams classified as Fish and Wildlife, in the Black Warrior River Basin.
COLBERT COUNTY
Messer LLC, 1040 Industrial Drive, Cherokee, Alabama 35616, NPDES Permit Number AL0040100, located at the same address, for re-issuance of a permit, which authorizes discharges resulting from cooling tower blowdown, non-contact condensate, and stormwater runoff associated with inorganic chemical manufacturing discharging through Outfall DSN001 to an unnamed tributary to the Tennessee River, classified as Fish & Wildlife, in the Tennessee River Basin. The facility obtains cooling water from a cooling water intake structure (CWIS) operated by another entity. The Department has previously made a determination that the CWIS represents the best technology available (BTA) to minimize adverse environmental impact in accordance with Section 316(b) of the Federal Clean Water Act (33 U.S.C, section 1326).
DALLAS COUNTY
*International Paper – Riverdale, 601 County Rd 78, Selma, AL 36703, NPDES Permit Number AL0003018, located at the same address for reissuance of a permit which authorizes discharges resulting from process wastewater, sanitary wastewater, cooling tower blowdown, landfill leachate, and stormwater from industrial activities, through DSN002 and DSN003 to the Alabama River, classified as Fish & Wildlife, in the Alabama River Basin; stormwater from process areas, through DSN004 and DSN006 to an unnamed tributary to the Alabama River, classified as Fish & Wildlife, in the Alabama River Basin; and storm water from process areas and fire tank overflow, through DSN005 to an unnamed tributary to the Alabama River, classified as Fish & Wildlife, in the Alabama River Basin. In accordance with Section 316(b) of the federal Clean Water Act (33 U.S.C. section 1326) and the federal regulations (40 CFR Part 125), if applicable, the cooling water intake structure used by the Permittee has been evaluated using available information. At this time, the Department has determined that the cooling water intake structure used by the Permittee represents the best technology available (BTA) to minimize adverse environmental impact in accordance with Section 316(b) of the federal Clean Water Act (33 U.S.C. sSection 1326).
WASHINGTON COUNTY
Tate & Lyle Sucralose, LLC, 588 Industrial Road, McIntosh, AL 36553, NPDES Permit Number AL0069736, located at the same address, for modification of a permit to update the toxicity instream waste concentration at DSN001. The permit authorizes discharges resulting from treated process wastewater, boiler blowdown, non-contact cooling water, sanitary wastewater, salt recovery system wastewater, and stormwater associated with the production of Sucralose, through DSN001 to the Tombigbee River, classified as Fish & Wildlife, in the Tombigbee River Basin. *Facility is a Major

Alabama Wholesale Stone, Inc. – Alabama Wholesale Stone Mine #3, 1480 County Road 36 Oneonta, Alabama 35121, NPDES Permit No. AL0084524, located at 84 Solomon Road, Oneonta, Blount County, Alabama, for issuance of a permit that limits discharges of treated drainage from dimensional stone quarry with incidental dirt and/or chert and associated areas, discharging to Groundwater and an unnamed tributary to Calvert Prong , classified as Fish and Wildlife, in the Black Warrior River Basin.

Elmore Sand & Gravel, Inc. - Scott Pit, Post Office Box 189, Elmore, Alabama 36025, NPDES Permit No. AL0084517, located at 132 Marion Spillway Road, Elmore, Elmore County, Alabama, for issuance of a permit that limits discharges of treated drainage from a wet and dry preparation construction sand and gravel mine and associated areas, discharing to Groundwater and Mortar Creek, classified as Fish and Wildlife, in the Alabama River Basin.

The subject permit regulates the discharge of treated wastewater to the Tennessee River (Wilson Lake), which is classified as Public Water Supply, Swimming, and Fish and Wildlife in the Tennessee River Basin.

Dallas County Board of Education, Post Office Box 1056, Selma, AL 36701, NPDES Permit Number AL0044296, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Valley Grande Elementary WWTP, 2765 Dallas County Road 81, Selma, AL 36703, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to an unnamed tributary to Beech Creek, which is classified as Fish and Wildlife in the Alabama River Basin.

Town of Town Creek, Post Office Box 190, Town Creek, AL 35672, NPDES Permit Number AL0066974, for reissuance of a permit which limits the discharge of pollutants from treated wastewater from Town Creek WWTP, 446 County Road 216, Town Creek, AL 35672, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Tennessee River (Wilson Lake), which is classified as Public Water Supply, Swimming and Other Whole-Body Water-Contact Sports, and Fish and Wildlife, in the Tennessee River Basin.

Lee County Board of Education, 2410 Society Hill Road, Opelika, AL 36804, NPDES Permit Number AL0043656, for reissuance of a permit which limits the discharge of pollutants from treated domestic from Beauregard High School Lagoon, 7343 Alabama Highway 51, Opelika, AL 36804, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Chewacla Creek, which is classified as Public Water Supply and Fish and Wildlife, in the Tallapoosa River Basin.
Lee County Board of Education, 2410 Society Hill Road, Opelika, AL 36804, NPDES Permit Number AL0043664, for reissuance of a permit which limits the discharge of pollutants from treated domestic from Beulah High School Lagoon, 4848 Lee Road 270, Valley, AL 36854, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to an unnamed tributary to Halawakee Creek, which is classified as Fish and Wildlife, in the Chattahoochee River Basin.
Lee County Board of Education, 2410 Society Hill Road, Opelika, AL 36804, NPDES Permit Number AL0043672, for reissuance of a permit which limits the discharge of pollutants from treated domestic from Loachapoka High School Lagoon, 685 Lee County Road 61, Loachapoka, AL 36865, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to an unnamed tributary to Choctafaula Creek, which is classified as Fish and Wildlife, in the Tallapoosa River Basin.
MONTGOMERY COUNTY
Pike Road Sewer, LLC, 5455 Troy Highway, Montgomery, AL 36116, NPDES Permit Number AL0084499, for the initial issuance of a permit which limits the discharge of pollutants from treated domestic wastewater Pike Road Clean Water Facility, Trotman Drive, Pike Road, Alabama 36064, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Catoma Creek, which is classified as Fish and Wildlife, the Alabama River Basin.
The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations.
Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/public-notices, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice. COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS. In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.
A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit. The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.
After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record. The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.
