NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE
INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS
The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:
Industrial Facilities
LIMESTONE COUNTY
Prowood, LLC - Athens, 2801 East Beltline Avenue Northeast, Grand Rapids, Michigan 49525-9680, NPDES Permit Number AL0065684, located at 19560 AL Highway 127, Athens, Alabama 35614-6810, for reissuance of a permit, which authorizes discharges resulting from stormwater runoff associated with the lumber and wood products industry including wood treating operations and stormwater discharges from fueling and petroleum storage and handling areas, through DSN001 to an unnamed tributary to Swan Creek, classified as Fish and Wildlife, in the Tennessee River Basin.
MADISON COUNTY
National Copper LLC, 3333 Stanwood Boulevard, Huntsville, AL 35811, NPDES Permit Number AL0029483, located at the same address, for reissuance of a permit, which authorizes discharges resulting from storm water runoff associated with copper tubing re-draw mill operations, through DSN001 to an unnamed tributary to Chase Creek, classified as Fish and Wildlife, in the Tennessee River Basin; and non-contact cooling water from a remediated ground source, through DSN002 to an unnamed tributary to Chase Creek, classified as Fish and Wildlife, in the Tennessee River Basin. In accordance with Section 316(b) of the federal Clean Water Act (33 U.S.C. section 1326) and the federal regulations (40 CFR Part 125), if applicable, the cooling water intake structure used by the Permittee has been evaluated using available information. At this time, The Department has determined that the 316(b) regulations are not applicable to the facility because the Permittee obtains cooling water from private wells.

Gene’s Dozer Service, Inc. – Fell’s Dirt Pit, 14820 Bishop Trace, Lillian, Alabama 36549, NPDES Permit No. AL0074250, located at 14820 Bishop Trace, Lillian, Baldwin County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry preparation construction sand and gravel mine and associated areas, discharging to Groundwater and to Lillian Swamp, classified as Fish and Wildlife, in the Perdido River Basin.
BARBOUR COUNTY
Imerys Refractory Minerals USA, Inc. – J.R. Wood Pits #8 & #23, 377 Highway 131 Eufaula, Alabama 36072, NPDES Permit No. AL0058271, located on County Road 75, Eufaula, Barbour County, Alabama, for issuance of a permit that limits discharges of treated drainage from a bauxitic and kaolin clay mine and associated areas, discharging to an unnamed tributary to Piney Woods Creek, classified as Fish and Wildlife, in the Choctawhatchee River Basin.

Imerys Refractory Minerals USA, Inc. – Respress Property, 377 Highway 131, Eufaula, Alabama 36072, NPDES Permit No. AL0083984, located on Henry County Road 86 East, Henry County, Alabama, for issuance of a permit that limits discharges of treated drainage from a bauxitic and kaolin clay mine and associated areas, discharging to an unnamed tributary to Abbie Creek, classified as Fish and Wildlife, in the Chattahoochee River Basin.

ST. CLAIR COUNTY
BES Industries, LLC - Wadsworth Pit, 709 Lake Cresent Dr., Hoover, Alabama 35226, NPDES Permit No. AL0078727, located on Easonville Road, Cropwell, St. Clair County, Alabama, for issuance of a permit that limits discharges of treated drainage from a fire clay mine and associated areas, discharging to an unnamed tributary to the Coosa River (Logan Martin Lake), classified as Fish and Wildlife, in the Coosa River Basin.
National Cement Company of Alabama, Inc. - Mitchell Mountain Quarry, 2000 South Bridge Parkway, Suite 600, Birmingham, Alabama 35209, NPDES Permit No. AL0076171, located at 80 National Cement Drive, Ragland, St. Clair County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry preparation crushed and broken limestone mine and associated areas, discharging to an unnamed tributary to Broken Arrow Creek, classified as Fish and Wildlife, in the Coosa River Basin.
Ragland Clay Products, LLC - Ragland Clay Products, Post Office Box 160, Ragland, Alabama 35131, NPDES Permit No. AL0077461, located at 61 Industrial Drive, Ragland, St. Clair County, Alabama, for issuance of a permit that limits discharges of treated drainage from a dry preparation shale and/or common clay mine, brick manufacturing plant, and associated areas, discharging to Trout Creek and an unnamed tributary to Trout Creek, classified as Fish and Wildlife, in the Coosa River Basin.

CRENSHAW COUNTY
Town of Brantley, Post Office Box 44, Brantley, AL 36009, NPDES Permit Number AL0022641, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and from Brantley Lagoon, Glenwood Road, Brantley, AL 36009, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Conecuh River, which is classified as Fish and Wildlife, in the Escambia River Basin.
Town of Dozier, Post Office Box 216, Dozier, AL 36028, NPDES Permit Number AL0060518, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater from Dozier Lagoon, Lagoon Drive, Dozier, AL 36028, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Conecuh River, which is classified as Fish and Wildlife, in the Escambia River Basin.
JEFFERSON COUNTY
Sharon Heights Mobile Home Park, 621 Bivens Brookside Road, Birmingham, AL 35214, NPDES Permit Number AL0057827, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Sharon Heights Mobile Home Park, 621 Bivens Brookside Road, Birmingham, AL 35214, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Fivemile Creek, which is classified as Fish and Wildlife, in the Black Warrior River Basin.
TALLADEGA COUNTY
Utilities Board of the City of Sylacauga, Post Office Box 207, Sylacauga, AL 35150, NPDES Permit Number AL0020010, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from the Fairmont WWTP, 885 Brooks Road, Sylacauga, Alabama 35150, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Tallaseehatchee Creek, which is classified as Fish and Wildlife, in the Coosa River Basin.
TUSCALOOSA COUNTY
Knobloch, Inc., Post Office Box 679, Leeds, AL 35094, NPDES Permit Number AL0068420, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from East Tuscaloosa-West Jefferson WWTP, 12874 Woodland Park Circle, McCalla, AL 35111, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Mud Creek, which is classified as Fish and Wildlife, in the Cahaba River Basin.
The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations; and for those in the coastal area, are consistent with the Alabama Coastal Management Program.
Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/public-notices, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice. COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS. In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.
A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit. The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.
After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record. The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.
