NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

BALDWIN COUNTY

Aquila Seafood, Inc., 17309 River Road, Bon Secour, AL 36511, NPDES Permit Number AL0002321, located at same, for reissuance of a permit, which authorizes discharges resulting from Screened washdown water from seafood packing and freezing operations, cooler water, and screened water from loading/unloading of seafood, through DSN001 to Bon Secour River, classified as Swimming and Fish & Wildlife, in the Mobile River Basin.

BARBOUR COUNTY

Carbo Ceramics, Inc. – Eufaula Plant, 36 Arch Drive, Eufaula, AL 36027, NPDES Permit Number AL0082643, located at the same address, for reissuance of a permit, which authorizes discharges resulting from process wastewater resulting from ceramic bead manufacturing operations, process utility water, and kaolin grit runoff, through DSN002 to the Chattahoochee River (Walter F. George Lake), classified as Swimming/Fish & Wildlife, in the Chattahoochee River Basin; and stormwater run-off from ceramic bead manufacturing operations and petroleum storage and fueling areas, through DSN003 and DSN004 to an unnamed tributary to Barbour Creek, classified as Fish & Wildlife, in the Chattahoochee River Basin. The Department has determined that the facility is not subject to Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326) since the entity providing water is a public water system.

HALE COUNTY

Southern Natural Gas Co.-Gallion Compressor Station, PO Box 68, Gallion, AL 36742, NPDES Permit Number AL0069019, located at 7414 Highway 1, Gallion, AL 36742, for reissuance of a permit, which authorizes discharges resulting from groundwater and storm water collected in floor sumps, and air compressor condensate, discharging through DSN001 to Unnamed Tributary to Yellow Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.

JACKSON COUNTY

Tennessee Alloys Company, 101 Garner Road, Bridgeport, AL 35740, NPDES Permit Number AL0000485, located at the same address, for reissuance of a permit, which authorizes discharges resulting from storm water runoff from industrial activity through DSN001 to Unnamed Tributary to the Tennessee River, classified as Fish and Wildlife in the Tennessee River Basin; and resulting from storm water runoff from the raw material yard and finished goods storage through DSN002 to Unnamed Tributary to the Tennessee River, classified as Fish and Wildlife in the Tennessee River Basin.

MORGAN COUNTY

Parker Towing Company, Inc. - Port of Decatur, 1001 3rd Street, Northport, Alabama 35476, NPDES Permit Number AL0061247, located at 500 Market Street NW, Decatur, Alabama 35601, for reissuance of a permit, which authorizes resulting from stormwater runoff associated with the operation of trucking and transfer distribution terminal, including employee parking areas, shipping and receiving areas, general warehousing, asphalt transfer, trucking and transfer of manufactured pipe, barge transfer cranes, access service roads and hydrostatic test waters discharging through Outfall DSN002 to the Tennessee River, classified as Swimming/Fish & Wildlife, in the Tennessee River Basin; stormwater runoff associated with the operation of trucking and transfer distribution terminal, including employee parking areas, shipping and receiving areas, grain storage areas, general warehousing, asphalt transfer, trucking and transfer of manufactured pipe, barge transfer cranes, access service roads and bulk petroleum storage and fueling areas discharging through Outfall DSN003 to the Tennessee River, classified as Swimming/Fish & Wildlife, in the Tennessee River Basin; stormwater runoff associated with the operation of trucking and transfer distribution terminal, including employee parking areas, shipping and receiving areas, general warehousing, asphalt transfer, trucking and transfer of manufactured pipe, barge transfer cranes, access service roads and petroleum storage and fueling areas discharging through Outfall DSN004 to the Tennessee River, classified as Swimming/Fish & Wildlife, in the Tennessee River Basin.

Vulcan Construction Materials, LLC – South Russellville Quarry, 1200 Urban Center Drive Birmingham, Alabama 35242, NPDES Permit Number AL0072117, located at 14460 Highway 243 Russellville, Franklin County, Alabama, for reissuance of a permit that limits discharges of treated drainage from a limestone quarry and associated areas discharging to unnamed tributaries to Harris Creek, classified as Fish and Wildlife, in the Tennessee River Basin.

Alabama Department of Conservation and Natural Resources, 104 Lakepoint Drive, Eufaula, Alabama 36027, NPDES Permit Number AL0023906, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from the Alabama Department of Conservation Lakepoint State Park, 104 Lakepoint Drive, Eufaula, Alabama 36027, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates treated wastewater to the Chattahoochee River (Walter F George Lake), a waterway classified as Fish and Wildlife in the Chattahoochee River Basin.

BULLOCK COUNTY

City of Union Springs Utilities Board, PO Box 229, Union Springs, Alabama 36089, NPDES Permit Number AL0060445, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and storm water discharge from Union Springs WWTPs and Land Application, 27790 US Highway 82, Union Springs, Alabama 36089, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates treated wastewater to a Sprayfield, in the Choctawhatchee River Basin.  The facility is located in the drainage basin of Bluff Creek, waterway classified as Fish and Wildlife in the Choctawhatchee River Basin.

CHOCTAW COUNTY

Utilities Board of the Town of Butler, PO Box 455, Butler, AL 36904, NPDES Permit Number AL0050211, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Butler HCR Lagoon, Oscar Gray Road, Butler, AL 36904, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Wahalak Creek, classified as Fish and Wildlife, in the Tombigbee River Basin.

CHOCTAW COUNTY

Utilities Board of the Town of Gilbertown, 13217 Choctaw Ave, Gilbertown, AL 36908, NPDES Permit Number AL0082848, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Gilbertown Water Resources Recovery Facility, 13217 Choctaw Ave, Gilbertown, AL 36908, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Okatuppa Creek, classified as Fish and Wildlife, in the Tombigbee River Basin.

COFFEE COUNTY

The City of Enterprise, PO Box 311000, Enterprise, AL 36331, NPDES Permit Number AL0020036, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and stormwater runoff from the Enterprise College Street WWTP, 1760 Pistol Road, Enterpise, AL 36331, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater and stormwater runoff to an Unnamed Tributary to Blanket Creek, classified and Fish & Wildlife, in the Choctawhatchee River Basin.

The Utilities Board of the City of Ozark, PO Box 1125, Ozark, AL 36361, NPDES Permit Number AL0058688, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from the Ozark Northeast Lagoon, 1330 County Road 36E, Ozark, AL 36360, for the purpose of meeting federal and state water quality regulatory standards,  The subject permit regulates the discharge of treated wastewater to West Fork Choctawhatchee River, classified as Fish & Wildlife, and Swimming, in the Choctawhatchee River Basin.

DE KALB COUNTY

Alabama Department of Transportation, 3417 Highway 71, Dutton, AL 35744, NPDES Permit Number AL0027821, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from I-59 Welcome Center, approximate Mile Marker 240 on I-59, Valley Head, AL 35989, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Red River Branch, classified as Fish and Wildlife, in the Coosa River Basin.

HALE COUNTY

City of Moundville, PO Box 98, Moundville, AL 35474, NPDES Permit Number AL0058122, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Moundville Lagoon, Lagoon Road, Moundville, AL 35474, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Black Warrior River (Warrior Lake), classified as Fish and Wildlife, in the Black Warrior River Basin.

LAUDERDALE COUNTY

Lauderdale Christian Nursing Home, 2019 County Road 394, Killen, Alabama 35645, NPDES Permit Number AL0056901, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Lauderdale Christian Nursing Home Lagoon, 2019 County Road 394, Killen, Alabama 35645, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to West Fork Sixmile Creek, classified as Fish & Wildlife, in the Tennessee River Basin.

St Clair County Board of Education, 410 Roy Drive, Ashville, AL 35953, NPDES Permit Number AL0043061, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Ashville School Lagoon, 33225 Highway 231 South, Ashville, AL 35953 for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to North Fork Dry Creek, classified as Fish & Wildlife, in the Coosa River Basin.

St Clair County Board of Education, 410 Roy Drive, Ashville, AL 35953, NPDES Permit Number AL0070041, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Ragland School WWTP, 1060 Main Street, Ragland, AL 35131, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Trout Creek, classified as Fish & Wildlife, in the Coosa River Basin.

SUMTER COUNTY

Industrial Development Authority of Sumter County, PO Box 1059, Livingston, AL 35470, NPDES Permit Number AL0062456, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Port of Epes Industrial Complex, 760 Port of Epes Hwy, Epes, AL 35460, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Tombigbee River (Demopolis Lake), classified as Fish and Wildlife, in the Tombigbee River Basin.

Town of Cuba, PO Box 385, Cuba, AL 36907, NPDES Permit Number AL0064386, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Cuba WWTP, Sumter County Highway 1, Cuba, AL 36907, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to Alamuchee Creek, classified as Fish and Wildlife, in the Tombigbee River Basin.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.  The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.  To find the response to comments and final permit determination, you may search by the appropriate permit number listed in this notice.
