PROPOSED ADMINISTRATIVE ORDER

Macon County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Jeffrey F. Potter and Guycan LLC, landowners and operators of a business on real property located off 0 Auburn Street, (Parcel ID Numbers 07 04 19 4 000 061.000 and 07 09 29 2 000 022.000), in Tuskegee, Macon County, Alabama.

The violation consisted of Jeffrey F. Potter and Guycan LLC creating and not properly closing an unauthorized dump (UAD) on the aforementioned property.

The Department is proposing a civil penalty in the amount of $75,000. The Order, if issued, would require Jeffrey F. Potter and Guycan LLC to cease and desist operating or contributing to the aforementioned UAD and submit a site remediation and closure plan to the Department. This plan must outline the actions that will be taken to remove and properly dispose of all regulated solid waste, as well as timeline for the completion of all remediation and closure actions.

Interested persons may submit written comments, including a request for a hearing, within 30 days of the publication date of this notice to:

The comment period shall end at the close of business 30 days from the publication date of this notice.
