PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Consent Order to Group Properties, LLC, which owns property located at 11690 Southfork Drive, (Parcel ID Numbers 63-42-02-04-0-000-002.000 and 63-42-02-03-0-000-004.000), in Duncanville, Tuscaloosa County, Alabama.

The violation involved the failure to properly remediate and close an unauthorized dump (“UAD”).

The Department is proposing a civil penalty in the amount of $9,600. The Order, if issued, would require Group Properties, LLC to cease and desist operating or contributing to any UADs, in addition to providing an abatement plan to the Department. This plan must outline the actions to be taken to remove all regulated solid waste from the property and ensure its proper disposal at an authorized facility, along with a schedule for the completion of all abatement activities.

The comment period shall end at the close of business 30 days from the publication date of this notice.
