PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Amrize Cement, Inc., the owner/operator of a portland cement manufacturing facility currently operating in Theodore, Mobile County, Alabama.

The violations consisted of three (3) instances where emission testing indicated Finish Mill No. 2 failed to meet the applicable particulate matter emission limits, numerous failures to conduct daily visible emissions monitoring of 18 emission points, numerous failures to conduct monthly visible emissions monitoring while the sources of emissions were operating, multiple instances of failure to meet accuracy requirements when conducting relative accuracy test audits (RATAs), and failure to conduct the required RATA for the hydrochloric acid (HCl) continuous emissions monitoring system (CEMS) in a timely manner.

The Department is proposing a civil penalty in the amount of $250,000.00. The Order, if issued, would require Amrize Cement, Inc. to pay the Alabama Department of Environmental Management within 45 days of the effective date, and comply with the terms, limitations, and conditions of the Permit and Department’s regulations immediately.
