PROPOSED ADMINISTRATIVE ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Darius Trumer due to his failure to properly close an illegal scrap tire accumulation located at 11439 Lake Drive (Parcel ID Nos. 63-27-02-09-0-001-009.000, 63-27-02-09-0-001-008.000, 63-27-02-09-0-001-007.000, 63-27-02-09-0-001-006.000, and 63-27-02-09-0-001-004.000) in McCalla, Tuscaloosa County, Alabama.

The violation consisted of Darius Trumer creating and not properly closing an illegal scrap tire accumulation.

The Department is proposing a civil penalty in the amount of $4,000. The Order, if issued, would require Darius Trumer to cease and desist operating or contributing to the illegal scrap tire accumulation, in addition to requiring the submission of an abatement plan to the Department. This plan must detail the actions that will be taken to remove and properly dispose of all scrap tires, scrap tire material, and all other regulated solid waste from the property, along with a schedule for the completion of all abatement activities.

The comment period shall end at the close of business thirty days from the publication date of this notice.
