PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management (ADEM) is proposing to issue An Consent Order to Wilkes Construction Company Inc which operates The Preserve at Moccasin Bayou, ALR10C5UK, located in the city of Elberta, Baldwin County, Alabama.

The violations consisted of commencing and continuing NPDES construction activity without implementing effective BMP’s producing non-compliant discharges.

The order, if issued, would require the operator to pay a civil penalty in the amount of $78,000.

Interested persons may submit written comments, including request for a hearing within 30 days of the publication date of this notice, to:

The comment period shall end at the close of business 30 days from the publication date of this notice. Copies are also available at a cost as shown in ADEM Admin. Code r.335-1-1-.06(6).
