PROPOSED CONSENT ORDER

Coffee County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management (ADEM) is proposing to issue an Order to Troy Fillingim, Hwy 125 Lot 1 & Hwy 125 Lot 2, on the western side of Hwy 125, in Jack, Coffee County, Alabama.

The violations consisted of a lack of effective erosion and sediment control BMPs being implemented and/or maintained, the noncompliant discharge of sediment offsite, and failure to respond to a Notice of Violation (NOV).

The order, if issued, would require the operator to comply with the AWPCA and applicable ADEM regulations as well as pay a civil penalty in the amount of $2,500.

Interested persons may submit written comments, including a request for a hearing, within 30 days of the publication date of this notice, to:

The comment period shall end at the close of business 30 days from the publication date of this notice. This notice is hereby given this 3rd day of November, 2026, by authorization of the Alabama Department of Environmental Management.
