PROPOSED CONSENT ORDER

Marshall County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management (ADEM) is proposing to issue an Order to The Stewart/Perry Company, Inc. – Sand Mountain Marketplace, located north of Highway 431 between Sorter Road and H.T. Greer Road, in the City of Albertville, Marshall County, Alabama.

The violations consisted of: Effective BMPs had not been implemented and/or maintained; Noncompliant discharge and accumulation of solids/sediment offsite and in State waters; Water Quality Violation; Noncompliance with the requirements of ADEM NPDES construction stormwater rules.

The order, if issued, would require the operator to correct all violations; implement and maintain effective BMPs; pay a civil penalty in the amount of $33,700.
