PROPOSED ADMINISTRATIVE ORDER

Shelby County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Roy and Shirley Minton Harvill (“Harvill”), who own real property located at 2125 Sun Valley Road (17 2 03 0 000 009.004) in Harpersville, Shelby County, Alabama.

The violation involved the failure to properly remediate and close an unauthorized dump (“UAD”).

The Department is proposing a civil penalty in the amount of $3,000. The Order, if issued, would require the Harvill’s to cease and desist operating or contributing to any UADs, as well as submitting an abatement plan to the Department. This plan must outline the actions to be taken to remove all regulated solid waste from the property, and ensure its proper disposal at an authorized facility, along with a schedule for the completion of all abatement activities.

Interested persons may submit written comments, including a request for a hearing, within 30 days of the publication date of this notice to:
