PROPOSED ADMINISTRATIVE ORDER

Mobile County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Ricky Mitchell who owns the real property located at 5301 Porters Lane (Parcel ID No. 23 06 23 2 000 020.000), in Eight Mile, Mobile County, Alabama, where an unauthorized dump (“UAD”) was discovered.

The violation consisted of Ricky Mitchell creating and not properly closing a UAD.

The Department is proposing a civil penalty in the amount of $6,000. The Order, if issued, would require Ricky Mitchell to cease and desist operating or contributing to the aforementioned UAD and submit a site remediation and closure plan to the Department. This plan must detail the actions that will be taken to remove and properly dispose of all regulated solid waste from the property, as well as a timeline for the completion of all remediation and closure actions.
