PROPOSED ADMINISTRATIVE ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue an Administrative Order to Kronospan, LLC, the owner/operator of a medium density fiber board and particle board manufacturing facility currently operating in Eastaboga, Calhoun County, Alabama.

The violations consisted of failure to follow MACT UU LDAR regulations, failure to notify of permit deviations in a timely manner, failure to properly operate a control device, failed compliance tests (particle board particulate condensable BACT limit), and incorrect information in compliance certifications.

The Department is proposing a civil penalty in the amount of $250,000. The Order, if issued, would require Kronospan to pay the Alabama Department of Environmental Management within 45 days of the effective date, and comply with the terms, limitations, and conditions of the Permit and Department’s regulations immediately.

The comment period shall end at the close of business 30 days from the publication date of this notice. Copies are also available at a cost as shown in ADEM Admin. Code r.335-1-1-.06(6).
