PROPOSED ADMINISTRATIVE ORDER

Macon County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Jeffrey F. Potter, Andrea G. Potter, and Guycan LLC, who are the landowners of the real property and/or operators of a business located of 0 Nancy Street, (Parcel ID Numbers 07 04 20 0 003 016.015 and 07 04 20 0 003 016.000), in Tuskegee, Macon County, Alabama.

The violation consisted of Jeffrey F. Potter, Andrea G. Potter, and Guycan LLC creating and not properly closing an unauthorized dump (“UAD”) on the aforementioned property.

The Department is proposing a civil penalty in the amount of $75,000. The Order, if issued, would require Jeffrey F. Potter, Andrea G. Potter, and Guycan LLC to cease and desist operating or contributing to the aforementioned UAD and submit a site remediation and closure plan to the Department. This plan outlines the actions that will be taken to remove and properly dispose of all regulated solid waste, as well as timeline for the completion of all remediation and closure actions.

The comment period shall end at the close of business 30 days from the publication date of this notice.
