PROPOSED ADMINISTRATIVE ORDER

Macon County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Jeffrey F. Potter, Clarence Marable, and Guycan LLC, the owners of real property and operators of a business located at 0 Hare Street (Parcel ID No. 07 04 19 4 000 060.000) in Tuskegee, Macon County, Alabama, where an unauthorized dump (“UAD”) was discovered.

The violation consisted of Jeffrey F. Potter, Clarence Marable, and Guycan LLC creating and not properly closing the aforementioned UAD.

The Department is proposing a civil penalty in the amount of $100,000. The Order, if issued, would require Jeffrey F. Potter, Clarence Marable, and Guycan LLC to cease and desist operating or contributing to the aforementioned UAD and submit a site remediation and closure plan to the Department. This plan must outline the actions that will be taken to remove and properly dispose of all regulated solid wastes, as well as a timeline for the completion of all remediation and closure actions.

The comment period shall end at the close of business thirty days from the publication date of this notice. Copies are also available at a cost as shown in ADEM Admin r. 335-1-1-.06(6).
