PROPOSED ADMINISTRATIVE ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue a Unilateral Order to Highway 160, LLC, which operates a mining facility known as Mulvehill Property. Mulvehill Property is located on Highway 31 (near the intersection of Interstate 65 and US Highway 31), Warrior, Blount County, Alabama.
The violations noted in the Unilateral Order consist of conducting surface mining operations without a valid National Pollutant Discharge Elimination System (NPDES) Permit, discharging pollutants into a water of the State without a valid NPDES Permit, failure to install treatment structures or best management practices, and failure to respond to a Notice of Violation issued by the Department.
The Department is proposing a civil penalty in the amount of $62,500. The Order, if issued, would require Highway 160, LLC to pay the proposed civil penalty, prepare and submit a complete NPDES Permit Application, submit an engineering report detailing the site conditions and any necessary corrective actions, and submit a certification of compliance with the order.

The comment period shall end at the close of business 30 days from the publication date of this notice. Copies of the proposed rules and the Summary of Reasons are available for viewing at each of the locations listed below by appointment and on the ADEM webpage at https://adem.alabama.gov/public-notices. Copies are also available at a cost as shown in ADEM Admin. Code r.335-1-1-.06(6).
