PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management (ADEM) is proposing to issue an Order to Grantham Development Company, LLC, Grantham, NPDES ALR10C12D, on the southern side of Eastchase Lane, in Montgomery, Montgomery County, Alabama.

The violations consisted of a lack of effective erosion and sediment control BMPs being implemented and/or maintained, the noncompliant discharge of sediment offsite, and failure to respond to a Notice of Violation (NOV).

The order, if issued, would require the operator to submit a plan to correct all violations; implement and maintain effective BMPs; comply with applicable ADEM rules and permit requirements; perform corrective actions; pay a civil penalty in the amount of $32,700.

Interested persons may submit written comments, including a request for a hearing, within 30 days of the publication date of this notice, to:

The comment period shall end at the close of business 30 days from the publication date of this notice. This notice is hereby given this 6th day of April, 2026, by authorization of the Alabama Department of Environmental Management.
