PROPOSED ADMINISTRATIVE ORDER

Madison County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management (ADEM) is proposing to issue an Order to Empire Rentals and Wholesale, LLC – 253 Meryal Lane, located at 253 Meryal Lane, in the City of New Market, Madison County, Alabama.

The violations consisted of: Operating an NPDES construction site without, or outside of, NPDES coverage; Effective BMPs had not been implemented and/or maintained; Noncompliant discharge and accumulation of solids/sediment offsite and in State waters; Water Quality Violation; Noncompliance with the requirements of ADEM NPDES construction stormwater rules.

The order, if issued, would require the operator to: correct all violations; implement and maintain effective BMPs; pay a civil penalty in the amount of $43,200.

This notice is hereby given this 8th day of April 2026, by authorization of the Alabama Department of Environmental Management.

The comment period shall end at the close of business 30 days from the publication date of this notice.
