PROPOSED ADMINISTRATIVE ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Douglas E. and Amy Hicks for failure to close an unauthorized dump (UAD) located at US Highway 11 (10-03-08-0-000-005.000), Valley Head, DeKalb County, Alabama.

The violation consisted of Douglas E. and Amy Hicks creating and not properly closing a UAD.

The Department is proposing a civil penalty in the amount of $3,000. The Order, if issued, would require Douglas E. and Amy Hicks to cease and desist operating or contributing to the aforementioned UAD and submit an abatement plan to the Department. This plan would outline the steps that will be taken to remove and properly dispose of all regulated wastes and include a schedule for abatement completion.

Interested persons may submit written comments, including a request for a hearing, within 30 days of the publication date of this notice to:

The comment period shall end at the close of business 30 days from the publication date of this notice.
