PROPOSED CONSENT ORDER

Jackson, Jefferson, Morgan, Sumter, Talladega, and Winston Counties

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§ 22-22A-1 through §§ 22-22A-17, as amended, and the Solid Wastes and Recyclable Materials Management Act (SWRMMA), Ala. Code §§ 22-27-1 to 22-27-18, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Denali Water Solutions, LLC, a By-Product Distributor (Registration No. BUD0000-054574) located at 220 S. Commerce Avenue, Russellville, AR 72801.

The violations listed in the Order consist of failure to abide by land application requirements, failure to abide by spill mitigation requirements, failure to abide by vector and bird mitigation requirements, failure to abide by best management practices, and failure to have a required plans for land application site.

The Department is proposing a civil penalty in the amount of $36,400.00. The Order, if issued, would require the facility to correct all violations above within the prescribed timeframes, and to operate in compliance with ADEM Admin. Code 335-13 in the future.
