PROPOSED ADMINISTRATIVE ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Charity Maddox for establishing and not closing unauthorized dump (“UAD”) on real property located off Lynwood Road (Parcel ID No. 26 14 09 31 0 001 085.000) in Daleville, Dale County, Alabama.

The violation consisted of Charity Maddox creating and not properly closing a UAD.

The Department is proposing a civil penalty in the amount of $6,000. The Order, if issued, would require Charity Maddox to cease and desist operating or contributing to the Unauthorized Dump in addition to requiring the submission of an abatement plan to the Department. This plan must detail the actions that will be taken to remove and properly dispose of all regulated solid waste from the property, along with a timeline for the completion of all abatement activities.
