PROPOSED ADMINISTRATIVE ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to CDM Scrap Metals LLC that operated a scrap metal business on the real property located at 737 Cotaco Florette Road (Parcel ID No. 17 01 01 0 000 026.000) in Somerville, Morgan County, Alabama, where an unauthorized dump (“UAD”) was discovered.
The violation consisted of CDM Scrap Metals LLC creating and not properly closing a UAD.
The Department is proposing a civil penalty in the amount of $7,000. The Order, if issued, would require CDM Scrap Metals LLC to cease and desist operating or contributing to the aforementioned UAD and submit a site remediation and closure plan to the Department. This plan would outline the actions that will be taken to remove and properly dispose of all regulated solid wastes, as well as a timeline for the completion of all remediation and closure actions.

The comment period shall end at the close of business 30 days from the publication date of this notice.
