PROPOSED ADMINISTRATIVE ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code ยง 22-22A-1 et seq., as amended, the Alabama Department of Environmental Management is proposing to issue an Administrative Order (Order) to Richard S. and Edward H. Burns, the owners of the property located at 244 County Road 379 (31-05-22-0-000-014.001) in Boaz, DeKalb County, Alabama.
The violations listed in the Order consisted of Richard S. and Edward H. Burns creating and not properly closing an illegal accumulation of scrap tires, as well as operating in a manner that violated the state regulations regarding open burning.
The Department is proposing a civil penalty in the amount of $173,270. The Order, if issued, would require Richard S. and Edward H. Burns to comply with all applicable requirements of Divisions 335-4 and 335-3 of the ADEM Administrative Code. In addition, Richard S. and Edward H. Burns shall be required to submit to the Department a remediation plan that details the actions that will be taken to completely remediate and close the illegal scrap tire accumulation, along with a schedule for the completion of all remediation and closure actions.
Interested persons may submit written comments, including a request for a hearing, within thirty (30) days of the publication date of this notice to:

The comment period shall end at the close of business thirty (30) days from the publication date of this notice.
