PROPOSED ADMINISTRATIVE ORDER

Dale County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to James A. Brady, c/o Naomi Brady (“Brady”) who own property located at 4559 County Road 43 (Parcel ID Nos. 26 14 07 35 0 000 005.000 and 26 14 07 35 0 000 005.001) in Newton, Dale County, Alabama.

The violation involved the failure to properly remediate and close an Unauthorized Dump (“UAD”) and Illegal Scrap Tire Site (“STS”).

The Department is proposing a civil penalty in the amount of $8,270. The Order, if issued, would require Brady to cease and desist operating or contributing to any UADs and STSs, as well as submitting an abatement plan to the Department. This plan must outline the actions to be taken to remove all regulated solid waste and scrap tires from the property and ensure their proper disposal at an authorized facility, along with a schedule for the completion of all abatement activities.

The comment period shall end at the close of business 30 days from the publication date of this notice.
