NOTICE OF PROPOSED MODIFICATION OF THE OPERATING PERMIT UNDER THE ALABAMA HAZARDOUS WASTES
MANAGEMENT AND MINIMIZATION ACT (AHWMMA) AND REQUEST FOR COMMENTS

The U.S. Department of the Army, Anniston Army Depot (ANAD) of Anniston, Alabama submitted to ADEM an application for modification of its hazardous waste operating permit for the Static Detonation Chamber (SDC) which was used to manage hazardous waste at its facility (EPA I.D. Number AL3 210 020 027) located at Anniston, Alabama. The Department has determined the facility’s modification application to be complete and has prepared a draft permit in accordance with State regulations.
ANAD performs thermal treatment of energetics from conventional waste military munitions (WMM) by open burning, open detonation, and rocket motor firing. Additionally, the facility receives shipments of WMM from Department of Defense (DoD) off-site sources for reuse, recycle or recovery, or for disposal. Containerized industrial hazardous waste is stored in permitted hazardous waste storage buildings and WMM is stored in permitted storage igloos. ANAD’s proposed permit modification is to remove the Static Detonation Chamber (SDC) facility from the application and permit. The SDC processed non-chemical agent contaminated munition components. Upon completion of operations, and because there are no further mission requirements, the Anniston SDC was closed and demolished in accordance with the approved closure plan. This permit modification also proposes the incorporation of planned changes to the Open Detonation Sediment Pond. The sediment pond is being redeveloped to improve the existing drainage of the site by removing the existing sediment pond and reinstalling a newly designed sediment pond. In addition to the removal of the SDC Facility and the OD sediment pond the Department proposes the incorporation of the Corrective Measures Work Plan, Burning Ground #2, Solid Waste Management Unit 65 Revision 2, into the Facility’s permit.

Persons wishing to comment may do so, in writing or by email, to the Department's named contact above by 5:00 PM on August 3, 2026. In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.
A written request for a public hearing may also be filed by 5:00 PM on August 3, 2026, and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing upon receipt of a significant number of technical requests.
After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the AHWMMA, the Federal Resource Conservation and Recovery Act (RCRA), and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request. Notice will be sent to any person requesting notice of the final action.
