PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to AlphaPet, Inc., the owner/operator of a chemical manufacturing facility currently operating in Decatur, Morgan County, Alabama.

The violations consisted of the failure to include and monitor one hundred (100) total components that should have been included in the facilities leak detection and repair (LDAR) program. These components include connectors and valves that contain at least 5% of hazardous air pollutants (HAPs) by weight. The facility also failed to monitor an additional twenty-three (23) connectors within the regulatory required timeframe.

The Department is proposing a civil penalty in the amount of $36,960. The Order, if issued, would require AlphaPet, Inc. to pay the Alabama Department of Environmental Management within 45 days of the effective date, and comply with the terms, limitations, and conditions of the Permit and Department’s regulations immediately. The facility will also be required to complete a full audit of their LDAR program to identify any additional components that should be included in their LDAR program.
