NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

CHILTON COUNTY

West Fraser Inc - Maplesville Lumber Mill, 7475 Alabama Highway 22, Maplesville, AL 36750, NPDES Permit Number AL0025437, located at the same address, for reissuance of a permit, which authorizes discharges resulting from stormwater associated with lumber production through DSN001-DSN008 to an unnamed tributary to Mulberry Creek, classified as Fish & Wildlife, in the Alabama River Basin, vehicle washwater; iron filter backwash, wet decking water, fire pump cooling system water, air compressor condensate, kiln condensate and well pump lubricator water through DSN009 to an unnamed tributary to Mulberry Creek, classified as Fish & Wildlife, in the Alabama River Basin.

JEFFERSON COUNTY

Allworth LLC, 500 Medco Road, Birmingham, AL 35217, NPDES Permit Number AL0032298, located at the same address, for reissuance of a permit, which authorizes discharges resulting from stormwater runoff from secondary containment areas, through DSN001 to Fivemile Creek, classified as Fish and Wildlife, in the Black Warrior River Basin; facility stormwater runoff through DSN005 to Fivemile Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.

Univar Solutions USA Inc., 3300 Ball Street, Birmingham, AL 35234, NPDES Permit Number AL0021695, located at the same address, for reissuance of a permit, which authorizes discharges resulting from stormwater runoff from bulk chemical storage operations through DSN002 to Village Creek classified as Limited Warmwater Fishery in the Black Warrior River Basin.

US Steel Corporation - Fairfield Works Exum Site, 5700 Valley Road, Fairfield, AL 35064, NPDES Permit Number AL0065773, located at Pleasant Grove Road, Fairfield, AL 35064, for reissuance of a permit, which authorizes discharges resulting from storm water and groundwater from landfill and material storage site and scrap metal salvage operation, through DSN001 to Camp Branch, classified as Fish and Wildlife, in the Black Warrior River Basin.

MARENGO COUNTY

G2O Technologies, LLC, 5365 County Road 57, Demopolis, AL 36732, NPDES Permit Number AL0067881, located at the same address, for reissuance of a permit, which authorizes discharges resulting from stormwater runoff associated with the production of Aluminum Sulfate (Alum) through DSN001 to an unnamed tributary to Double Creek, classified as Fish & Wildlife, in the Lower Tombigbee River Basin.

MORGAN COUNTY

Indorama Ventures Xylenes & PTA, LLC, 1401 Finley Island Road, Decatur, Alabama 35601, NPDES Permit Number AL0000108, located at the same address, for reissuance of a permit, which authorizes discharges resulting from treated process wastewater associated with organic chemical manufacturing, treated sanitary wastewater, groundwater and stormwater runoff discharging through Outfall DSN001 to the Tennessee River, classified as Swimming/Fish & Wildlife, in the Tennessee River Basin; Stormwater runoff, cooling tower and boiler blowdown, cooling tower blowdown, neutralized deionization backwash, filter backwash and clarifier underflow, hydrostatic test water, miscellaneous water from Calpine and Praxair, and miscellaneous utility wastewater discharging through Outfall DSN002 to the Tennessee River, classified as Swimming/Fish & Wildlife in the Tennessee River Basin; Stormwater runoff from process and non-process areas associated with organic chemical manufacturing discharging through Outfalls DSN003, DSN004, DSN005, DSN016, DSN017, DSN018, DSN019, DSN020, DSN021, and DSN023 to the Tennessee River classified as Swimming/Fish & Wildlife in the Tennessee River Basin; Stormwater runoff from process and non-process areas associated with organic chemical manufacturing discharging through Outfalls DSN009, DSN010, DSN012, DSN013, and DSN014 to an unnamed tributary to the Tennessee River, classified as Fish & Wildlife in the Tennessee River Basin.  At this time, the Department has determined that the cooling water intake structure represents the best technology available (BTA) to minimize adverse environmental impacts in accordance with Section 316(b) of the Federal Clean Water Act (33 U.S.C section 1326).

SHELBY COUNTY

Conrad Yelvington Distributors, Inc. - Calera Terminal, 4636 Scarborough Drive, Lutz, FL 33559, NPDES Permit Number AL0078018, 1622 Highway 84, Calera, AL 35040, for reissuance of a permit, which authorizes discharges resulting from stormwater runoff from storage and transloading of aggregates including gypsum, petroleum coke, coal, iron ore, clinker, quicklime, soda ash, mill scale, slag, bottom ash and other inert materials through DSN001 to an unnamed tributary to Dry Creek, classified as Fish and Wildlife, in the Cahaba River Basin.

WASHINGTON COUNTY

Alabama Power Company - Washington County Cogeneration Plant, PO Box 2641; BIN 12N-0830, Birmingham, AL 35291, NPDES Permit Number AL0071951, located at 1638 Industrial Road, McIntosh, AL 36553, for reissuance of a permit, which authorizes discharges resulting from Cooling tower blowdown, boiler blowdown, storm water, and [wastewater from] DSN001A, through DSN001; and Non-process steam condensate through DSN002. Both outfalls discharge to Unnamed Tributary to Tombigbee River, classified as Fish and Wildlife, in the Tombigbee River Basin.

DALLAS COUNTY

Cosby Carmichael, Inc. – Cosby Plant No. 1, PO Box 100, Selma, Alabama 36701, NPDES Permit Number AL0058611, located at 637 River Road, Selma, Dallas County, Alabama, for reissuance and modification of a permit that limits discharges of treated drainage from a wet and dry preparation construction sand and gravel mine and associated areas, discharging to Groundwater, Beech Creek, and an unnamed tributary to Alabama River, classified as Fish and Wildlife, in the Alabama River Basin.

Public, Semi-Public and Private Facilities
MONROE COUNTY

The Water Works and Sewer Board of the City of Monroeville, Post Office Box 674, Monroeville, AL 36460, NPDES Permit Number AL0027782, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Monroeville Double Branch, 2189 Highway 47 South, Monroeville, AL 36460, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater and storm water to UT to Limestone Creek, which is locally known as Double Branch Creek, classified as Fish and Wildlife, in the Alabama River Basin.

SUMTER COUNTY

Sumter County Commission, Post Office Box 328, Livingston, AL 35470, NPDES Permit Number AL0071056, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Bellamy Lagoon, 135 Alder Street, Bellamy, AL 36901, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to a Sucarnoochee River, classified as Fish and Wildlife, in the Tombigbee River Basin.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period. 

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record.
