NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Sanders Lead Company, Inc./Wiley Sanders Trucklines, Inc., P.O. Drawer 707, Troy, Alabama 36081, NPDES Permit Number AL0066052, located at 100 Sanders Road, Troy, Alabama 36079, for modification of a permit which limits the discharge resulting from storm water runoff from non-process portions of the lead smelting operation, the wastewater treatment area, capped RCRA units, trailer parking, equipment storage, the truck maintenance area, and the ammonium sulfate handling area associated with the scrubber system, discharging through DSN004 into an unnamed tributary to Big Creek, classified as Fish & Wildlife, in the Choctawhatchee River Basin.

General Shale Brick, Inc. - Lumpkin Mill Mine, Post Office Box 3547, Johnson City, TN 37602, NPDES Permit Number AL0080012, located on State Highway 25, Centre, Cherokee County, Alabama, for issuance of a permit that limits discharges of treated drainage from a shale and/or common clay mine and associated areas, discharging to Lumpkin Mill Creek and an unnamed tributary to Lumpkin Mill Creek, classified as Fish and Wildlife, in the Coosa River Basin.

ELMORE COUNTY

EEDA, Ltd. - Nicholls Pit, 3417 Boxwood Drive, Montgomery, Alabama 36111, NPDES Permit Number AL0057215, located at 4240 Rifle Range Road, Wetumpka, Elmore County, Alabama, for issuance of a permit that limits discharges of treated drainage from a construction sand and gravel mine and associated areas, discharging to Groundwater and an unnamed tributary to Tallapoosa River, classified as Fish and Wildlife, in the Tallapoosa River Basin.

Miller Contracting, LLC - Miller Pit #3, Post Office Box 159, Pascagoula, Mississippi 39568, NPDES Permit Number AL0076104, located on Ramsey Road, Grand Bay, Mobile County, Alabama, for issuance of a permit that limits discharges of treated drainage from a construction sand and gravel mine and associated areas, discharging to Franklin Creek, classified as Fish and Wildlife, in the Escatawpa River Basin.

Riverside Refractories, Inc. - Wadsworth Pit, 201 Truss Ferry Road, Pell City, Alabama 35128, NPDES Permit Number AL0078727, located on Easonville Road, Cropwell, St Clair County, Alabama, for issuance of a permit that limits discharges of treated drainage from a fire clay mine and associated areas, discharging to an unnamed tributary to Coosa River, classified at Fish and Wildlife, in the Coosa River Basin.

Warrior Met Coal Mining, LLC - Mine No. 7, 16243 Highway 216 Brookwood, Alabama 35444, NPDES Permit Number AL0029181, located at 18069 Hannah Creek Road, Brookwood, Tuscaloosa County, Alabama, for modification of a permit that limits discharges of treated drainage from an underground coal mine, a low volume sewage treatment facility, and associated areas, discharging to Clark Branch, Davis Creek, unnamed tributaries to Davis Creek, unnamed tributaries to Hannah Mill Creek, unnamed tributaries Lye Branch, unnamed tributaries to Mudd Creek, Prudes Creek, unnamed tributaries to Prudes Creek,  unnamed tributary to Rockhouse Creek, Shoal Creek, unnamed tributary to Texas Creek, and unnamed tributaries to Woods Creek, all classified as Fish and Wildlife in the Black Warrior River Basin.

MARSHALL COUNTY

Cherokee Ridge Property Owners Association, 4000 Cherokee Ridge Drive, Union Grove, AL 35175, NPDES Permit Number AL0064181, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and storm water runoff from Cherokee Ridge Property Owners Association WWTP, 4000 Cherokee Ridge Drive, Union Grove, AL 35175 for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to a Sprayfield, in the Tennessee River Basin.  The subject permit also regulates the discharge of storm water runoff to Unnamed Tributary to Hughes Creek, classified as Fish & Wildlife, in the Tennessee River Basin.  The facility is located in the drainage basin of an Unnamed Tributary to Hughes Creek, a waterway classified as Fish & Wildlife, in the Tennessee River Basin.

PICKENS COUNTY

Gordo Water, Gas and Sewer Board, Post Office Box 348, Gordo, AL 35466, NPDES Permit Number AL0061981, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Gordo WWTP, US Highway 82, Gordo, AL 35466, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Little Bear Creek, classified as Fish & Wildlife, in the Upper Tombigbee River Basin.

ST CLAIR COUNTY

Alabama Wastewater Systems, Inc., 849 Aviation Parkway, Smyrna, TN 37167, NPDES Permit Number AL0079651, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater and storm water runoff from Blackjack WWTF, Old Acton Road, Margaret, AL 35112 for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater and storm water runoff to Middle Black Creek, classified as Fish & Wildlife, in the Cahaba River Basin.

SUMTER COUNTY

City of York, Post Office Box 37, York, AL 36925, NPDES Permit Number AL0023361, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from York Lagoon, Weatherly Street, York, AL 36925, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to an Alamuchee Creek, classified as Fish & Wildlife, in the Lower Tombigbee River Basin.

WILCOX COUNTY

City of Camden, 108 Water Street, Camden, AL 36726, NPDES Permit Number AL0023701, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Camden North WWTP, Kennedy Street, Camden, AL 36726, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to a Rockwest Creek, classified as Fish & Wildlife, in the Alabama River Basin.

 

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/newsEvents/publicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the Federal Water Pollution Control Act and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request.  Notice will be sent to any person requesting notice of the final action.
