PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Hikae Aluminum Processing, L.L.C., the owner/operator of a secondary aluminum processing facility currently operating in Ashville, St. Clair County, Alabama.

The violations consisted of the failure to install and operate a bag leak detection system for each fabric filter (baghouse) exhaust stack, failure to monitor and record baghouse inlet temperatures, and failure to submit timely its semi-annual excess emissions summary report (SEER) report.

The Department is proposing a civil penalty in the amount of $34,000.00. The Order, if issued, would require Hikae Aluminum Processing, L.L.C., to pay the Alabama Department of Environmental Management in accordance with the schedule included in the final order and comply with the terms, limitations, and conditions of the Permit; operate and maintain the air pollution control devices and capture systems at the facility at all times; install and maintain all required continuous monitoring systems no later than November 1, 2026; and submit quarterly reports to the Department no later than 15 days after the end of the reporting period detailing the installation of the continuous monitoring system devices.
