Marion County

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management (ADEM) is proposing to issue an Order to BTE Truck Center, LLC – BTE, located to the north of Elliott Road and west of Alabama Highway 129, near the City of Winfield, Marion County, Alabama.

The violations consisted of: Operating an NPDES construction site without, or outside of, NPDES coverage; Effective BMPs had not been implemented and/or maintained; Discharge and/or accumulation of solids/sediment offsite and/or in State waters; Failure to respond to a Notice of Violation; and Noncompliance with the requirements of ADEM NPDES construction stormwater rules.

The order, if issued, would require the operator to: correct all violations; implement and maintain effective BMPs; pay a civil penalty in the amount of $42,300.
