PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management (ADEM) is proposing to issue an Order to RB Miller Properties, LLC RB Miller Property, NPDES ALG890895, located east of the intersection of Highway 11 and Hagler Road, in Coaling, Tuscaloosa County, Alabama.

The violations consisted of: disturbance exceeding five (5) acres, disturbance not correctly identified on the NOI on file, unpermitted and/or noncompliant discharges; effective BMPs not implemented and/or maintained; accumulation of sediment offsite; noncompliance with applicable ADEM rules and permit requirements.

The Department is proposing a civil penalty in the amount of $10,000. The Order, if issued, would require the operator to: pay the penalty; complete a comprehensive inspection of the Facility, offsite conveyances and affected State waters; submit a plan or plans to correct all cited violations; implement and maintain effective BMPs; comply with applicable ADEM rules and permit requirements; perform corrective actions; submit certification, signed by a ADEM recognized Qualified Credential Professional, that all onsite deficiencies have been corrected, and full compliance with the ALG890000 General Permit.

The comment period shall end at the close of business 30 days from the publication date of this notice.
