PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to National Cement Company of Alabama, Inc., the owner/operator of a Portland cement manufacturing facility currently operating in Ragland, St. Clair County, Alabama.

The violations consisted of multiple exceedances of the 30-day rolling emission limits for mercury and sulfur dioxide from Kiln 2, as well as multiple exceedances of the opacity limits for Finish Mill No. 1 via stack 71DC01 and failure to document the corrective actions taken after opacity was noted, as required by Major Source Operating Permit No. 410-0002.

The Department is proposing a civil penalty in the amount of $250,000. The Order, if issued, would require National Cement Company of Alabama, Inc. to pay the Alabama Department of Environmental Management within 45 days of the effective date, and immediately comply with the terms, limitations, and conditions of the Permit and Department’s regulations.

The comment period shall end at the close of business 30 days from the publication date of this notice.
