NOTICE OF PUBLIC HEARING FOR PROPOSED RENEWAL, MODIFICATION, AND VARIANCE
OF A MUNICIPAL SOLID WASTE LANDFILL PERMIT UNDER THE ALABAMA SOLID WASTES
AND RECYCLABLE MATERIALS MANAGEMENT ACT AND REQUEST FOR COMMENTS

Notice is hereby given that ADEM will hold a Public Hearing on July 31, 2025, at 6:00 p.m., in the “Commission Chambers” of the Dothan Civic Center located at 126 N. Saint Andrews Street, Dothan, AL 36303 for the proposed renewal, modification, and variance for the Solid Waste Disposal Facility Permit for the City of Dothan Sanitary Landfill (Permit 35-06).
This is the second public notice and hearing for the proposed permit action in order to ensure that all potentially interested persons have the opportunity to provide comments in accordance with ADEM Admin. Code 335-13-5-.03. Persons who have previously submitted comments during the comment period ending May 29, 2025, are not required to resubmit those comments for them to be considered as part of this current action, however, such persons may submit additional comments during this second comment period should they choose to do so.
The proposed major modification would add 20.5 acres of MSW disposal area and 14.1 acres of C/D disposal area to the facility. The total permitted disposal area would increase from 53.6 acres to 88.2 acres. The total permitted area would consist of approximately 506.67 acres with 74.1 acres permitted for MSW disposal operations and 14.1 acres permitted for C/D disposal operations.
Two variances were requested by the City of Dothan. The first request is a variance from ADEM Admin. Code 335-13-4-.22(1)(b) and ADEM Admin. Code 335-13-4-.23(1)(c) to allow for two working faces at the facility. One working face would be for the MSW disposal area, and the other would be for the C/D disposal area. The second request is a variance from ADEM Admin. Code 335-13-4-.20(2)(c)2 to allow for 3:1 final slopes on the MSW expansion area.
Copies of the public notice, proposed permit, and complete application are available at http://app.adem.alabama.gov/eFile/ by entering Master ID 4007 and Land Permit Number 35-06 and at the following location Monday-Friday, except legal holidays, between 8:00 a.m. and 5:00 p.m. by appointment. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.
Persons wishing to comment may do so, in writing, to the Department's named contact below by 5:00 p.m. on July 31, 2025. Commenters should identify the appropriate permit number on the first page of their comments.

The purpose of the public hearing will be for interested parties to make oral and written comments into the public hearing record. Those wishing to make oral comments at the public hearing are also encouraged to submit those comments in writing. All comments must address the conditions of the proposed permit(s); the Department’s adherence to the applicable environmental laws, rules, and regulations in development of the proposed permit(s); or issues that have an impact on the applicant’s ability to meet applicable environmental laws, rules, and regulations to affect the final permit decision. In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit(s).
After consideration of all oral and written comments and consideration of the requirements of the Alabama Solid Wastes and Recyclable Materials Management Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will be posted to the Department’s website at http://app.adem.alabama.gov/eFile/. To find the response to comments and final permit determination, you may search by the permit or facility number listed in this notice.
