NOTICE OF APPLICATION FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT FOR DISCHARGE
INTO WATERS OF THE STATE OF ALABAMA AND REQUEST FOR COMMENTS

The following applicants have applied for an NPDES permit to discharge treated wastewater into waters of the State of Alabama:

Industrial Facilities

LAMAR COUNTY

Koppers Utility & Industrial Products, 16851 Highway 96, Kennedy, Alabama 35574, NPDES Permit Number AL0066184, located at the same address, for reissuance of a permit which authorizes discharges resulting from storm water runoff associated with lumber and wood products including wood treating operations using inorganic preservatives containing chromium, copper and arsenic, through DSN001 and DSN002 to unnamed tributaries to Luxapallila Creek, classified as Fish and Wildlife, in the Tombigbee River Basin; storm water runoff associated with lumber and wood products including wood treating operations using inorganic preservatives containing chromium, copper and arsenic, formulations using DCOI and the former use of chlorophenolics, through DSN003 and DSN005 to unnamed tributaries to Luxapallila Creek, classified as Fish and Wildlife, in the Tombigbee River Basin; storm water runoff associated with storage of raw lumber and wood, through DSN006 to an unnamed tributary to Luxapallila Creek, classified as Fish and Wildlife, in the Tombigbee River Basin; and storm water runoff associated with storage of lumber and wood products treated with preservatives, through DSN007 and DSN008 to unnamed tributaries to Luxapallila Creek, classified as Fish and Wildlife, in the Tombigbee River Basin. In accordance with ADEM Administrative Rule 335-6-10-.12, the Permittee has demonstrated that the proposed expanded discharges are necessary for important economic or social development in the area in which the waters are located.

COOSA COUNTY

Midsouth Paving, Inc. – Alexander City Quarry, 500 Riverhills Park, Suite 590, Birmingham, Alabama 35242, NPDES Permit No. AL0056448, located at 625 Coosa County Road 32, Alexander City, Coosa County, Alabama, for reissuance of a permit that limits discharges of treated drainage from a wet and dry preparation crushed and broken granite mine and associated areas, discharging to an unnamed tributary to Oakachoy Creek, classified as Fish and Wildlife, in the Tallapoosa River Basin.

MARSHALL COUNTY

C A Langford Company, Inc. – Plant #1, 2120 Warrenton Road, Guntersville, Alabama 35976, NPDES Permit No. AL0000060, located at 2120 Warrenton Road, Guntersville, Marshall County, Alabama, for modification of a permit that limits discharges of treated drainage from a dry and wet preparation limestone quarry and associated areas, discharging to unnamed tributaries to Browns Creek, classified as Fish and Wildlife, in the Tennessee River Basin.

TUSCALOOSA AND JEFFERSON COUNTY

Warrior Met Coal Mining, LLC – Mine No. 7, 16243 Highway 216, Brookwood, Alabama 35444, NPDES Permit No. AL0029181, located at 18069 Hannah Creek Road, Brookwood, Tuscaloosa and Jefferson Counties, Alabama, for modification of a permit that limits discharges of treated drainage from an underground coal mine, a low volume sewage treatment facility, and associated areas, discharging to Davis Creek, Prudes Creek, Shoal Creek, unnamed tributary to Clark Branch, unnamed tributaries to Davis Creek, unnamed tributaries to Hanna Mill Creek, unnamed tributaries to Mudd Creek, unnamed tributary to Lye Branch, unnamed tributaries to Prudes Creek, unnamed tributaries to Rockhouse Creek, unnamed tributaries to Texas Creek, unnamed tributaries to Whiteoak Creek, and unnamed tributaries to Woods Creek, classified as Fish and Wildlife, in the Black Warrior River Basin.

ETOWAH COUNTY

The Water Works and Sewer Board of the City of Gadsden, P.O. Box 800, Gadsden, AL 35902, NPDES Permit Number AL0083844, for re-issuance of a permit which limits the discharge of pollutants from filter backwash from Gadsden Water Filtration Plant, 625 Albert Rains Boulevard, Gadsden, AL 35901, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of filter backwash to a Coosa River (Neely Henry Lake), classified as Fish and Wildlife, in the Coosa River Basin.

JEFFERSON COUNTY

Springfield MPH, LLC, 10850 Wilshire Blvd, STE 301, Los Angeles, CA 90024, NPDES Permit Number AL0027642, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Forestdale Mobile Home Park, 2926 Una Street, Birmingham, AL 35214, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Fivemile Creek, which is classified as Fish and Wildlife, in the Black Warrior River Basin.

JEFFERSON COUNTY

SWWC Services, Inc., 728 Volare Drive, Birmingham, AL 35244, NPDES Permit Number AL0051195, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Johnson Elementary School Lagoon, 8300 Kermit Johnson Road, Pinson, AL 35126, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Self Creek, which is classified as Fish and Wildlife, in the Black Warrior River Basin.

MADISON COUNTY

City of Huntsville Water Pollution Control, 1802 Vermont Rd, Huntsville, AL 35802, NPDES Permit Number AL0049531, for re-issuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater from Western Area WWTP, 759 Landess Circle, Madison, AL 35756, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to Tennessee River (Wheeler Lake), classified as Swimming and Fish and Wildlife, in the Tennessee River Basin. The subject permit also regulates the discharge of storm water runoff to Blackwell Run, classified as Fish and Wildlife, in the Tennessee River Basin.

MARION COUNTY

Marion County Board Of Education, 188 Winchester Drive, Hamilton, AL 35570, NPDES Permit Number AL0054593, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Phillips High School Wetlands, 160 School Avenue, Bear Creek, AL 35543, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the UT to Bear Creek, which is classified as Fish and Wildlife, in the Tennessee River Basin.

PICKENS COUNTY

Gordo Water, Gas and Sewer Board, Post Office Box 1106, Gordo, AL 35466, NPDES Permit Number AL0061981, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Gordo WWTP, US Highway 82, Gordo, AL 35466, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Little Bear Creek, which is classified as Fish and Wildlife, in the Tombigbee River Basin.

SUMTER COUNTY

Town Of Cuba, Post Office Box 385, Cuba, AL 36907, NPDES Permit Number AL0064386, for reissuance of a permit which limits the discharge of pollutants from treated domestic wastewater from Cuba WWTP, Sumter County Highway 1, Cuba, AL 36907, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater to the Alamuchee Creek, which is classified as Fish and Wildlife, in the Tombigbee River Basin.

TALLADEGA COUNTY

Utilities Board of the City of Sylacauga, Post Office Box 207, Sylacauga, AL 35150, NPDES Permit Number AL0020001, for reissuance of a permit which limits the discharge of pollutants from treated domestic and industrial wastewater, and stormwater runoff from the J. Earl Ham WWTP, 610 Old Sylacauga Highway, Sylacauga, Alabama 35150, for the purpose of meeting federal and state water quality regulatory standards. The subject permit regulates the discharge of treated wastewater and stormwater runoff to Shirtee Creek and Darby Branch, which is classified as Fish and Wildlife, in the Coosa River Basin.


The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://adem.alabama.gov/public-notices, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice. COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS. In order to affect final decisions, comments must offer technically substantial information that is applicable to the draft permit. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 P.M. on the last day of the comment period.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit. The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record. The Department will post responses to comments as well as the final permit determinations to the Department’s website at http://app.adem.alabama.gov/eFile/.
