NOTICE OF PROPOSED MODIFICATION OF THE OPERATING PERMIT UNDER THE ALABAMA HAZARDOUS WASTES
MANAGEMENT AND MINIMIZATION ACT (AHWMMA) AND REQUEST FOR COMMENTS

The U.S. Department of the Army, Anniston Army Depot (ANAD) of Anniston, Alabama submitted to ADEM an application for modification of its hazardous waste operating permit for the Static Detonation Chamber (SDC) which was used to manage hazardous waste at its facility (EPA I.D. Number AL3 210 020 027) located at Anniston, Alabama. The Department has determined the facility’s modification application to be complete and has prepared a draft permit in accordance with State regulations.

ANAD performs thermal treatment of energetics from conventional waste military munitions (WMM) by static (closed) detonation, open burning, open detonation, and rocket motor firing. Additionally, the facility receives shipments of WMM from Department of Defense (DoD) off-site sources for reuse, recycle or recovery, or for disposal. ANAD is allowed to receive components of chemical agent munitions that are non-agent contaminated from offsite DoD facilities for treatment by static detonation. Containerized industrial hazardous waste is stored in permitted hazardous waste storage buildings and WMM is stored in permitted storage igloos. ANAD’s proposed permit modification is to incorporate closure procedures for the SDC facility. The SDC processed non-chemical agent contaminated munition components from the Pueblo Chemical Agent-destruction Pilot Plant (PCAPP) in Pueblo, CO and the Blue Grass Chemical Agent-destruction Pilot Plant (BGCAPP) in Richmond, KY. Upon completion of operations, and since there are no further mission requirements, the Anniston SDC will be closed and demolished in accordance with the proposed closure plan. In addition, the proposed permit modification includes provisions that require any other solid waste management units and areas of concern at the facility to be addressed.

Copies of the fact sheet, permit modification application, and draft AHWMMA permit are available for public inspection electronically via http://adem.alabama.gov/public-notices and at the following location Monday – Friday (except legal holidays) during the hours of 8:00 a.m. to 5:00 p.m. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing or by email, to the Department's named contact above by 5:00 PM on Monday, July 14, 2025.In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

A written request for a public hearing may also be filed within that 45-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing upon receipt of a significant number of technical requests.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the AHWMMA, the Federal Resource Conservation and Recovery Act (RCRA), and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request. Notice will be sent to any person requesting notice of the final action.
