PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue a Consent Order to TCI of Alabama, LLC (EPA Identification Number ALD983167891), which operates an electrical equipment recycling facility located at 101 Parkway East in Pell City, St. Clair County, Alabama.

The violations consisted of the following: storage of hazardous waste for greater than 90 days without a permit, failure to meet applicable central hazardous waste accumulation area requirements, failure to properly mark or label containers of hazardous waste, failure to provide records for review, and failure to submit ADEM Form 8700-12 annually.

The Department is proposing a civil penalty in the amount of $11,680. The Order, if issued, would require TCI of Alabama, LLC to comply with all applicable requirements of Division 14 of the ADEM Administrative Code.

The comment period shall end at the close of business 30 days from the publication date of this notice.
