PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to HS Automotive Alabama Inc., the owner/operator of a Miscellaneous Rubber Automotive Articles Manufacturing facility currently operating in Enterprise, Coffee County, Alabama.

The violations consisted of failure to minimize emissions of air contaminants, failure to submit an application for an Air Permit, and failure to comply with 40 CFR Part 60, Subpart VVV – Standards of Performance for Polymetric Coating of Supporting Substrates Facilities.

The Department is proposing a civil penalty in the amount of $80,000. The Order, if issued, would require HS Automotive Alabama, Inc. to:

1. Pay the Alabama Department of Environmental Management within 45 days of the effective date of this Order.
2. Comply with the stipulations of this Order under paragraphs (F)(1) through (F)(6) by December 31, 2025.
3. Pay the Alabama Department of Environmental Management stipulated penalties in the amount of $10,000.00 per month, beginning February 2026 and ending December 2026 for any month in which HS Automotive Alabama Inc. is not in compliance with the stipulations of this Order.
