NOTICE OF PUBLIC HEARING AND PUBLIC AVAILABILITY SESSION FOR PROPOSED
RENEWAL, MODIFICATION, AND VARIANCE OF A MUNICIPAL SOLID WASTE LANDFILL
PERMIT UNDER THE ALABAMA SOLID WASTES AND RECYCLABLE MATERIALS MANAGEMENT
ACT AND REQUEST FOR COMMENTS

Notice is hereby given that ADEM will hold a Public Hearing on May 22, 2025, at 6:00 p.m., in the “Commission Chambers” of the Dothan Civic Center located at 126 N. Saint Andrews Street, Dothan, AL 36303 for the proposed renewal, modification, and variance for the Solid Waste Disposal Facility Permit for the City of Dothan Sanitary Landfill (Permit 35-06).
The proposed major modification would add 20.5 acres of MSW disposal area and 14.1 acres of C/D disposal area to the facility. The total permitted disposal area would increase from 53.6 acres to 88.2 acres. The total permitted area would consist of approximately 506.67 acres with 74.1 acres permitted for MSW disposal operations and 14.1 acres permitted for C/D disposal operations.
Two variances were requested by the City of Dothan. The first request is a variance from ADEM Admin. Code 335-13-4-.22(1)(b) and ADEM Admin. Code 335-13-4-.23(1)(c) to allow for two working faces at the facility. One working face would be for the MSW disposal area, and the other would be for the C/D disposal area. The second request is a variance from ADEM Admin. Code 335-13-4-.20(2)(c)2 to allow for 3:1 final slopes on the MSW expansion area.
Additionally, the Department has scheduled a Public Availability Session to allow interested citizens to discuss questions with ADEM officials. The public availability session will be held from 4:30 p.m. to 6:00 p.m. on May 22, 2024, in Dothan, Alabama at the “2nd Floor Lobby Area” of the Dothan Civic Center located at 126 N. Saint Andrews Street, Dothan, AL 36303.
Copies of the public notice, proposed permit, and complete application are available at http://app.adem.alabama.gov/eFile/ by entering Master ID 4007 and Land Permit Number 35-06 and at the following location Monday-Friday, except legal holidays, between 8:00 a.m. and 5:00 p.m. by appointment. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

The purpose of the public hearing will be for interested parties to make oral and written comments into the public hearing record. Those wishing to make oral comments at the public hearing are also encouraged to submit those comments in writing. All comments must address the conditions of the proposed permit(s); the Department’s adherence to the applicable environmental laws, rules, and regulations in development of the proposed permit(s); or issues that have an impact on the applicant’s ability to meet applicable environmental laws, rules, and regulations to affect the final permit decision. In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit(s).
Persons wishing to comment may do so, in writing, to the Department's named contact above by May 29, 2025. Commenters should identify the appropriate permit number on the first page of their comments.
After consideration of all oral and written comments and consideration of the requirements of the Alabama Solid Wastes and Recyclable Materials Management Act, and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will be posted to the Department’s website at http://app.adem.alabama.gov/eFile/. To find the response to comments and final permit determination, you may search by the permit or facility number listed in this notice.
