NOTICE OF PROPOSED MODIFICATION OF THE POST CLOSURE PERMIT UNDER THE ALABAMA HAZARDOUS WASTES
MANAGEMENT AND MINIMIZATION ACT (AHWMMA) AND REQUEST FOR COMMENTS

Alabama State Port Authority (ASPA) of Mobile, Alabama, Alabama submitted to ADEM an application for modification of its Post-Closure Permit for the solid waste management units (SWMUs) which were used to manage hazardous waste at its facility (EPA I.D. Number ALD 058 221 326) located at 68 Virginia Street, Mobile, Alabama 36603. The Department has determined the facility’s permit modification application to be complete and has prepared a draft permit in accordance with State regulations.
ASPA is the facility owner and currently leases out the land for use as a container terminal, operated by Mobile Container Terminal, where cargo containers are transshipped between different vessels or vehicles. Two regulated units, SWMUs 2 and 7, were closed in 1990 with residual waste in place. In addition to the two regulated units, SWMUs 4, 5, 6, and 8 were identified as requiring corrective measures. SWMUs 4, 5, 6, and 8 previously functioned as a plant operations and storage area, wood product storage area, drainage ditch, and creosote unloading area, respectively. The modification is requested for the following reasons: to revise grammatical errors, update the Corrective Measures Implementation Plan (CMIP) for consistency with the permit application, revise the dense non-aqueous phase liquid recovery methodology for the Recovery Well System, update site inspection forms, and alter the design of the existing soil cover on a portion of SWMU 6 East. Portions of the SWMU 6 East concrete cap and soil cover will be removed and restored to support construction of a mechanically stabilized earth (MSE) wall foundation. The MSE wall is part of the Inter-Terminal Connector project, which will connect Garrows Bend Intermodal Container Transfer Facility and the subject site. In addition, the proposed permit modification includes provisions that require any other solid waste management units and areas of concern at the facility to be addressed.
Copies of the fact sheet, revised CMIP, and draft AHWMMA permit are available for public inspection electronically via http://adem.alabama.gov/public-notices and at the following location Monday – Friday (except legal holidays) during the hours of 8:00 a.m. to 5:00 p.m. A nominal fee for copying and/or mailing may be charged. Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing or by email, to the Department's named contact above by 5:00 PM on Monday, June 9, 2025. In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.
A written request for a public hearing may also be filed within that 45-day period and must state the nature of the issues proposed to be raised in the hearing. The Director shall hold a public hearing upon receipt of a significant number of technical requests.
After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the AHWMMA, the Federal Resource, Conservation and Recovery Act (RCRA) and applicable regulations, the Department will make a final determination. The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request. Notice will be sent to any person requesting notice of the final action.
