PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Fletcher Petroleum Co., LLC the owner/operator of the Brooklyn Field Area No. 1, a group of wellsites for gas and oil production, currently operating in Brooklyn, Conecuh County, Alabama.

The violations included the late submittal of multiple reports, operation of the CCL&T generator engine on propane longer than allowable without a stack test, and failure to maintain the engine catalyst.

The Department is proposing a civil penalty in the amount of $20,000.00. The Order, if issued, would require Fletcher Petroleum Co., LLC to pay the Alabama Department of Environmental Management within 45 days of the effective date, and comply with the terms, limitations, and conditions of the Permit and the Department’s regulations immediately.

The comment period shall end at the close of business 30 days from the publication date of this notice. A nominal fee for copying may be charged.
