PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Solutia, Inc., a Subsidiary of Eastman Chemical Company (EPA Identification Number ALD004019048), which operates a chemical manufacturing facility located at 702 Clydesdale Avenue in Anniston, Calhoun County, Alabama.
The violations consisted of the following: failure to keep satellite accumulation containers of hazardous waste closed, storage of hazardous waste for greater than ninety days without a permit, failure to post warning signs at each entrance to the central hazardous waste accumulation area, failure to properly manage containers of used oil, failure to properly manage containers of universal waste, and failure to provide records for review.
The Department is proposing a civil penalty in the amount of $10,560. The Order, if issued, would require Solutia, Inc., a Subsidiary of Eastman Chemical Company to comply with all applicable requirements of Division 14 of the ADEM Administrative Code.

The comment period shall end at the close of business 30 days from the publication date of this notice.
