PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Scottsboro Electric Power Board, the owner/operator of an electricity generation and distribution facility currently operating in Scottsboro, Jackson County, Alabama.

The violation consisted of exceeding the permitted annual hours of operation for the facility’s generators.

The Department is proposing a civil penalty in the amount of $26,000. The Order, if issued, would require Scottsboro Electric Power Board to submit an application for a permit that reflects current operating conditions, and pay the Alabama Department of Environmental Management within 45 days of the effective date, and comply with the terms, limitations, and conditions of the Permit and Department’s regulations immediately.

The comment period shall end at the close of business 30 days from the publication date of this notice. A nominal fee for copying may be charged.
