PROPOSED ADMINISTRATIVE ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue a Proposed Administrative Order to Kenneth W. Irey for failure to close an unauthorized dump located at 133 Circle C Road (21-09-32-0-000-013.000, 21-09-32-0-000-011.003), Trafford, Blount County, Alabama.
The violation consisted of Kenneth W. Irey creating and not properly closing an unauthorized dump.
The Department is proposing a civil penalty in the amount of $3000. The Order, if issued, would require Kenneth W. Irey to cease and desist creating or operating any unauthorized dumps and to submit an abatement plan to the Department. The plan must outline the measures that will be taken to remove and properly dispose of all regulated solid waste materials and provide a timeline for the completion of all abatement activities.

The comment period shall end at the close of business 30 days from the publication date of this notice.
