PROPOSED ADMINISTRATIVE ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to Johnnie L. and Ester Joe Stanton (“the Stantons) for failure to close an unauthorized dump site located at 25623 Stanton Road (05-43-05-22-0-000-015.000, 05-43-05-22-0-000-015.001, 05-43-05-22-0-000-018.000, 05-43-05-22-0-000-018.002), Daphne, Baldwin County, Alabama.

The violation consists of the Stantons creating and not properly closing an unauthorized dump and an illegal scrap tire accumulation.

The Department is proposing a civil penalty in the amount of $29,000. The Order, if issued, would require the Stantons to cease and desist from operating the unauthorized dump and illegal scrap tire accumulation, and to submit an abatement plan to the Department. This plan would require the removal and proper disposal of all regulated waste and a schedule for abatement completion.

The comment period shall end at the close of business 30 days from the publication date of this notice.
